After two years of briefing, the Supreme Court of California released its opinion in Rodriguez v. FCA, US LLC. And in this Halloween-Day opinion, there were no tricks—just confirmation of what automakers and other warrantors have been arguing for years: “new” does not mean “used.” ? Under the Song-Beverly Consumer Warranty Act, buyers of new motor vehicles are entitled to specific remedies if a manufacturer is unable to repair a new motor vehicle after a reasonable number of repair attempts. The statute provides that the remedy is available only as to a “new motor vehicle.” And it defines a “new motor vehicle” as one “bought or used primarily for personal purposes” as well as dealer-owned vehicles and demonstrators “sold with a manufacturer’s new car warranty.” Cal. Vista Maria provides abused and neglected girls with emotional, education, psychological and spiritual guidance to facilitate their transition to adulthood as productive, contributing members of society.?Bowman and Brooke has been an important part of the Dolly Drive event for many years. The most important component of the event is the support drawn for Vista Maria’s Foster Care program which helps transition those coming out of the residential treatment program who do not have homes of their own to go back to. #SocialEngagement #Community #CommunityEngagement

Bowman and Brooke attorneys CJ Schoenwetter and Eric D. Olson co-authored an article in Minnesota Lawyer, "Understanding the Supreme Court’s Latest Decisions on the Federal Arbitration Act." The Federal Arbitration Act (“FAA”) reflects the principle that contracting parties can choose to select the nature of dispute resolution of conflicts under the contract—including not only for substantive issues, but also for whether an arbitrator or a court can determine threshold issues. This third article of three wraps up our review of three FAA-related Supreme Court decisions issued between April 12 and March 23, 2024, interpreting the FAA. This final article discusses the Supreme Court’s decision in Bissonnette v. LePage Bakeries Park St., LLC, 601 U.S. 246 (2024)—which sought to resolve a three-way circuit split between the First, Second, and Eleventh Circuits—expanding the scope of the FAA’s transportation exemption to cover employees that do not work in the transportation industry. Bisonnette represents yet another decision by the Supreme Court that arguably narrows the scope of the FAA in favor of judicial proceedings. Read the article below.
