    Had the absolute privilege of sitting down to interview attorney, Ray Boucher for “Open Secret” last weekend. Ray has dedicated his impressive career to championing victims of injustice. He has settled cases of sexual abuse against the Catholic Church for his clients, collectively, for $1.2 Billion, with five more cases pending this year alone. When our film releases later this year, we’ll shed light on how corrupt institutions work together; silencing children, protecting predators, to maintain a reputation.     A proposed $880 million settlement was reached with the Roman Catholic Archdiocese of Los Angeles on behalf of 1,353 survivors of childhood sexual assaults by Clergy members. Ray Boucher, one of the members of Plaintiffs’ Liaison Counsel, noted that it has taken nearly two years to reach this settlement and praised the Archdiocese for not taking “the cowardly road of filing for bankruptcy,” as many other Catholic entities have done in recent months. “It is a bittersweet day, as it always is.” https://lnkd.in/gE4-MBCv

    Consumers who are cheated or misled by a business often face an uphill battle in getting compensation for their mistreatment. California and federal law prohibits companies from using deceptive and unsafe practices to exploit customers. Class action lawsuits are a powerful way for mistreated consumers to band together and demand justice for corporate wrongdoing. A class action lawsuit is filed by one or more representatives from the group of people harmed by the defendant. So, who can bring a consumer class action lawsuit? Someone who was hurt by: - False advertising - Bait and switch operations - A recalled or unsafe item - Frauds and scams -Product defects - Corporate privacy violations The individuals filing the lawsuit are called the “named plaintiffs.” There are specific legal regulations to ensure that the named plaintiffs in a class action lawsuit legitimately represent the interests of a larger group of consumers. The person who can file a class action suit should be someone who suffered the same type of wrongdoing as the rest of the group. The named plaintiff also shouldn’t have any conflicts of interest or alternative motives for seeking collective legal action. There is no precise minimum number of people legally required for a class action lawsuit in California. Some consumer class actions involve hundreds of people, while others comprise only a couple dozen. Generally, a court is unlikely to certify a class that’s made up of fewer than a dozen people. A lawyer is the best person to answer specific questions about who can file a class action lawsuit and what you need to get started.     In California, employers have a legal duty to protect their employees from harassment based on sex, before and after it happens. Employers who don’t invest time in sexual harassment education and investigation can be held legally responsible for misconduct on their watch. Workplace sexual harassment is banned under the federal Civil Rights Act of 1964 and California’s Fair Employment and Housing Act (FEHA). Generally, the law defines sexual harassment as unwanted sexual conduct in the workplace that: - Is severe or pervasive enough to interfere with an employee’s job, or - Is offered as a condition for receiving employment benefits. As part of California’s anti-harassment protections, employers are legally obligated to take the initiative to combat sexual misconduct in the workplace. For employers with five or more employees, additional sexual harassment training is required.
