In November 2024, the NYC Council passed the FARE Act, bringing changes to how broker fees are handled in the rental market. If it takes effect in June 2025, landlords will be responsible for broker fees when hiring an agent to lease their properties, rather than tenants covering the cost. Here’s what to know: ? If a landlord hires a broker to list a rental, they would cover the fee. ? Listings posted online (StreetEasy, Zillow, social media) will be considered landlord-represented, meaning no tenant-paid fees. ? Tenants can still hire their own brokers if they choose. ? The law could lead to adjustments in rental pricing and how listings are marketed. The FARE Act aims to lower upfront costs for renters, but some anticipate shifts in pricing and inventory as landlords adapt. There’s still debate on how this will impact the market overall.
