Partners Daniel O'Toole and Joshua Stern secured a $3,000,000 settlement for a client who injured his knees, neck, and back after being rear-ended by an Access-A-Ride bus. Our client did not seek treatment until three days after the accident, when the pain became too much to bear. To address the injuries, our client ultimately underwent cervical disc replacement, bilateral knee arthroscopies, pain management, and other conservative treatments.?? Despite claims that our client’s injuries were not causally related to the accident, our attorneys successfully settled this case for $3,000,000, which included the entire insurance policy above New York City Transit Authority’s Self-Insured Retention limits. If the defense did not offer the full $3,000,000, our attorneys were prepared to bring this case to trial.?

Partners Jeffrey Block and S. Joseph Donahue secured a $1,500,000 settlement for a client who injured his back, neck, and shoulder after another vehicle struck his car at an intersection. MRIs revealed disc herniations in our client’s lumbar and cervical spine, as well as tears in his left shoulder. When conservative treatment failed to resolve his pain, our client underwent lumbar fusion surgery. ? Despite the defense’s claims that our client’s injuries were caused by natural bodily deterioration rather than the accident, the case settled at mediation prior to trial.

Partners Daniel O'Toole and Frederick Aranki secured a $1,750,000 settlement for a Union Laborer who fell to the ground when the ladder he was working on broke, resulting in serious injuries to his right shoulder and arm. Arthroscopic surgery was required to repair tears in our client’s rotator cuff and biceps tendon, and he was unable to continue working after the accident. ?? Our firm filed a motion for summary judgment under Labor Law Section 240, which the defense filed a subsequent motion to dismiss. The case was settled while these motions were still pending.

Our client injured his lumbar spine in the fall, which ultimately required surgical intervention. Defense argued that the injuries claimed by our client were not causally related to his fall. They pointed out that the initial hospital records mentioned that the plaintiff felt low back pain when lifting heavy bricks at work.? ? Due to weakness in his left leg after the surgery, our client had a subsequent fall, sustaining consequential injuries to his left ankle and knees. These injuries required additional, extensive treatment. Despite the defendant's arguments, our attorneys managed to settle the case at the second mediation while on the trial calendar.??
