More customers means more scrutiny. Once your products land in mainstream stores, more eyes are on your company, wondering whether those products are truly vegan, organic, biodegradable, etc. You might be surprised at what the government actually defines as “organic” or “biodegradeable”. The last thing you want is to be ramping up production just in time to get hit with a Federal Trade Commission complaint because the government has an issue with your product packaging.

Slapping some Terms of Service on your website is not going to protect you from former, disgruntled customers. You probably don’t spend much time thinking about the Terms of Service on your website, but when an unhappy customer is threatening litigation, that oft-forgotten webpage becomes VERY important. But it’s not going to do you any good if it’s not legally enforceable. In order to be legally enforceable, a court has to be satisfied that the customer or client actually provided agreement to those terms. Having them click a checkbox is not always enough - courts want to see Terms of Service that are clearly and conspicuously called out.
