BFV attorneys were busy in court this week. Among them, Shareholder Katherine Silverman and Associate Olivia Spradley Mercer defended a BFV client in a bench trial involving a real estate dispute related to a right of first refusal in a lease. The bench trial in DeKalb Superior Court lasted three days, and now they wait for a verdict.

Back to ATL after an exciting trip to New Orleans for argument before the Fifth Circuit Court of Appeals. Ashley Bowcott and I were defending a district court win in a non-compete and trade secret misappropriation case. I am very thankful for the wonderful clients that trust us to navigate these complex cases. Now, we wait for an opinion!

In the latest noncompete saga, the Georgia Court of Appeals reaffirmed its previous holding that a noncompete typically cannot prevent an employee from working for a competitor “in any capacity”—also known as the “janitor rule.” BFV shareholder Benjamin Fink explains that Georgia courts will often strike down noncompetes if they are drafted too broadly and in a way that prohibits an employee from working for any competitor at all in any position, regardless of whether doing so would threaten a legitimate business interest of the employer.   https://lnkd.in/dfFrx5Jn
