On October 3, 2024, Robert Berluti, Chris Davidson and Brendan Cooke secured an Appeals Court victory protecting the value of a jury verdict of $360,000 that resulted in a judgment with accrued interest of $473,317. The Appeals Court held that two Superior Court judges mistakenly applied a partial payment of the judgment to the jury verdict amount ($360,000) instead of to the accrued statutory interest in remanding the case to the Superior Court for a corrected amended judgment. The financial significance being that applying the payment to the jury verdict amount would diminish the ongoing accrual of statutory interest.

Dunn, Christopher Davidson and Brendan Cooke secured a favorable settlement in representing?homeowners against the builder of their home.?The builder constructed the property using an LLC and provided the clients with a one-year limited warranty.?When the clients requested that the builder address substantial construction defects, the builder ignored their request, dissipated the company’s assets, and voluntarily dissolved the LLC.?The real estate litigation team brought suit on behalf of the homeowners seeking (i) to pierce the corporate veil of the LLC to hold the builder personally liable, and (ii) rescission of the contract for the sale of the home.???During the suit, the team successfully obtained a real estate attachment on the builder’s personal residence.??Ultimately, the case settled with the builder buying back the clients’ home for its current fair market value.
