A federal judge in Texas recently struck down the U.S. Department of Labor's (DOL) upcoming rule set to raise the minimum salary threshold for overtime-exempt employees that was set to take effect nationwide on January 1, 2025. In addition to halting the planned increase, the judge's ruling also walked back the July 2024 increase that previously raised the salary threshold to $43,888, reducing the current threshold to $35,568. While the DOL may choose to appeal this ruling, the timing of any potential appeal and the upcoming change to the presidential administration leaves many questions waiting to be answered. Given this development, #employers should prepare for increased scrutiny regarding the classification of roles within their organizations as exempt under the Fair Labor Standards Act (FLSA). NOTICE: Minimum Wage Increase for Covered Federal Contract Workers effective January 1, 2025. The U.S. Department of Labor (DOL) recently announced an upcoming minimum wage rate increase to $17.75 for workers on Federal contracts covered by Executive Order 14026. This change applies to all tipped and non-tipped workers on covered contracts. Contracts entered into, renewed, or extended before January 30, 2022, are typically subject to a lower minimum wage rate established by Executive Order 13658. #GovCon leaders should prepare to comply with this upcoming rate increase by determining if their contract(s) are covered by Executive Order 14026 and updating their payroll practices as needed to meet the new minimum wage.
