Spirit Airlines is set to emerge from bankruptcy after a New York bankruptcy judge approved its #Chapter11 plan. Under the plan, $795 million of secured debt will be converted into equity, while $840 million will be rolled into an exit note facility. Spirit will also receive a $350 million equity investment as part of its restructuring deal. The court's confirmation overruled objections from the U.S. Trustee's Office and the SEC, which raised concerns about the plan's opt-out mechanism for third-party releases. With bankruptcy courts nationwide divided on these provisions—especially in the wake of the Supreme Court's rejection of nonconsensual releases in Purdue Pharma LP's case—this ruling reinforces ongoing legal debates in corporate bankruptcy law. 'As courts continue to grapple with the enforceability of third-party releases, this decision highlights the evolving landscape of corporate restructuring,' said BAST AMRON LLP attorney Katie Tonkinson of the recent ruling.
