Two decades after the terrorist attacks of September 11, 2001 shocked the world, thousands of responders and survivors who were exposed to toxins from the World Trade Center site are still living a nightmare. Every day, Barasch & McGarry observes how cancer, respiratory disorders and other disabling and deadly diseases linked to the exposure continue to devastate families. We are proud to have represented James Zadroga, an NYPD detective who developed pulmonary fibrosis as a result of his exposure to the WTC toxic dust. His death persuaded Congress to pass the “James Zadroga 9/11 Health and Compensation Act” in 2010. The law reopened the 9/11 Victim Compensation Fund, which provides benefits to people whose illnesses resulted from exposure to WTC dust and ongoing health treatment for those sickened by the toxins. When it became clear that Congress had not sufficiently funded the VCF, Michael Barasch returned to Congress with labor union members, responders, downtown office workers and residents. In 2015, Congress reauthorized and extended the Zadroga Act. The new law extended the WTC Health Program for 75 years and the VCF was given an additional $4 billion -- but it was only extended until December, 2020. From October 2018 through June 2019, Michael and the dedicated attorneys and staff of Barasch & McGarry joined dozens of FealGood Foundation volunteers to advocate on behalf of the entire 9/11 community including sick responders, downtown residents, office workers, students and teachers. Michael was there every step of the way. He was there when the Senate passed the Bill and he was invited to the Rose Garden when the President signed the permanent extension and full funding into law. Since 2011, the re-opened VCF has awarded over $5 Billion to 25,000+ responders and survivors. Barasch & McGarry has represented more sickened 9/11 victims and recovered more money from the Victim Compensation Fund (over $3 billion) than any other law firm in the country.

  • Michael Barasch and the Barasch & McGarry - Lawyers for the 9/11 Community team went to Capitol Hill to urge Congress to fully fund the World Trade Center Health Program, which provide medical care for 9/11 responders and survivors with cancer, respiratory illnesses, and other health conditions. A broad coalition of 9/11 community advocates, including Senator Chuck Schumer and U.S. Senator Kirsten Gillibrand, Rep. Andrew Garbarino, FealGood Foundation ONE President John Feal, first responder organizations, and labor unions joined in support of the health program. “Every day, more and more people who were exposed to toxins in Lower Manhattan on and after 9/11 are diagnosed with cancer,” said Barasch. “The federal government has a responsibility to protect these 9/11 community members and their families.”

  • In 2010, 2015 and in 2019, we asked members of the 9/11 community to join us and reach out to their Representatives in Congress to convince them to pass and extend the 9/11 Zadroga Health & Compensation Act. Thousands of our clients around the country called their legislators and demanded their support. As a result of this mobilization, and the support of the unions, Congress did the right thing by fully funding and permanently extending the Victim Compensation Fund. Unfortunately, due to the explosion of cancers and medical inflation, the WTC Health Program is underfunded. You know that for thousands who are sick from the toxins at Ground Zero, 9/11 didn't end on 9/11. Thousands of responders and civilians continue to get cancer every year, and more people have now died from 9/11 illnesses than the 2,977 souls who perished that day. The World Trade Center Health Program is the lifeline the 9/11 Community depends on for the medical care they need and deserve. But it will face a funding shortfall in a few years unless Congress acts now. Now you have a chance, once again, to tell Washington that “Remembering 9/11 is not just a bumper sticker.” Our supporters in Congress have introduced the bipartisan “9/11 Responder and Survivor Health Funding and Correction Act of 2025” (H.R. 1410/S. 739) which would ensure that the program gets the funding it needs. I was in DC last week at a press conference which announced the bills and demanded that Congress fulfill its pledge to "Never Forget". Now that the legislation has been introduced, Congress needs to act. Your Members of Congress need to hear from you. Please send Congress a message. Tell your representatives you are a member of the 9/11 community and one of their constituents. Let them know how important the WTCHP is to you and that you want them to cosponsor the “9/11 Responder and Survivor Health Funding and Correction Act.” Our Friends at Citizens for the Extension of the James Zadroga Act Inc. have made it easy for you to contact your Members of Congress and ask them to cosponsor the bill. 1. All you need to do is go to their website (included in the first comment). 2. Type in your address. After a brief load, it will tell you who your Members of Congress are and whether they are already cosponsors of the bill. 3. If they aren't yet a cosponsor, type in your phone number. You will be connected to the Congressperson's office, free of charge, so you can talk to their staff and tell them you want their boss to cosponsor this bill. This legislation will ensure the funding for medical care now and into the future for all 9/11 responders and survivors. It will allow the Health Program to continue accepting new patients. People in the 9/11 Community are not going to stop getting sick. We need and deserve this health care!   • Ever since the Zadroga Act was introduced, a bipartisan coalition in the federal government has supported?9/11?responders and survivors who have been diagnosed with cancer and respiratory illness. That support has allowed the?9/11?community to access health care that saves lives and compensation awards that keep families in their homes. We thank New York State’s Congressional delegation for its successful campaign to protect the World Trade Center Health Program, as well as funds to research 9/11-related cancers. Next week, Michael Barasch will join John Feal and other 9/11 community advocates on Capitol Hill to campaign for the full funding of the health program, which needs $3 billion to continue providing medical care beyond 2027.
