Changes in the world of noncompete agreements have been particularly prevalent in recent weeks, most notably including court activity barring the FTC’s new noncompete ban and Pennsylvania’s new law restricting the use of certain noncompetes for health care practitioners. Employers should continue to monitor the status of the now-barred FTC noncompete ban, as well as Pennsylvania’s newly enacted Fair Contracting for Health Care Practitioners Act. The International Legal Technology Association (ILTA) recently released a 16-page executive summary of its annual Technology Survey. While generative AI (GenAI) makes up only 10% of the survey findings, one interesting statistic highlights the gap between small and large law firms' GenAI plans and early use. According to the summary, 37% of smaller firms (under 50 lawyers) have no plans for Microsoft Copilot for Microsoft 365, compared to less than 3% of large firms (over 350 lawyers). This disparity underscores the challenges firm decision-makers, clients, and technology providers face in adopting GenAI tools. As Todd Corham, CIO of Saul Ewing Arnstein & Lehr noted, the discrepancy between large and small firms' use of GenAI for Marketing and Business Development is even more pronounced. He suggests that business-side use cases might be the initial step for many firms. Still, risk mitigation or avoidance concerns may prevent them from fully embracing GenAI for legal practice. The ILTA survey raises a crucial question: how will the gap in GenAI usage between small and large firms impact client relationships and the choice of outside counsel?
