While working under one of our Senior Real Estate Associates, I learned a valuable lesson: Drafting contracts requires the "superpower" of looking into the future. By this he meant to understand how the Courts have dealt with the same or similar legal issue previously. “But Zara, the United Arab Emirates is not a Common Law jurisdiction?” I know. At our firm, it’s standard practice to review Cassation Court rulings, where available, on specific Articles of the Law before consulting with clients who need assistance with drafting some sort of contract or reviewing and amending an existing one. Obviously, the Law is essential when drafting a contract, but the Court's interpretation of the Law also plays a crucial role. By incorporating this practice, we're better prepared to draft and provide our client with a comprehensive, bird's-eye view of the entire process, even if it does not reach that point. This level of preparation instills confidence in our clients, assuring them that we are not just lawyers who understand the Law, but lawyers who know how to navigate complexities by being two steps ahead. This slight reliance on interpretations made by the Court underscores why litigation remains so crucial in drafting contracts that are intended to be governed by the laws of the United Arab Emirates.
