Another Landmark Win! Our firm is proud to announce a major appellate victory in the Eleventh Circuit Court of Appeals! The court affirmed the judgment in favor of our client, Nutradose Labs, LLC, in a case involving the enforcement of its trademark rights under the federal Lanham Act against a former distributor. The ruling highlights the importance of enforcing trademark rights and holding former distributors accountable when they operate without a license. Despite acting as a distributor, the defendant company did not have permission or authorization to hold itself out as a distributor, leading the Court to find the defendant company and its principal liable for trademark infringement. This decision sets a strong precedent for businesses seeking to safeguard their brands from unauthorized use.
