    Ex-Cyclone Alfred may have gone, but as residents recover, essential workers are still placed in hazardous conditions to ensure people can resume their daily lives. One of the poignant impacts of ex-Cyclone Alfred has been storm conditions and flooding, affecting those employees who work outside or need to travel as part of their work or even to just get to their place of employment. Employers are best advised to remember they have a responsibility to ensure that their workers are safe and not exposed to risks if they are undertaking any work during this period. Safe Work Australia gives employers guidance on the managing the risks of working in hazardous weather. If you do suffer a workplace injury, make sure you immediately notify your employer as that can make or break your WorkCover claim.   • Many older Australians have a deep fear about moving into aged care and are unaware of the options available to help them remain at home for longer. Earlier this month, an elderly married couple was found deceased in their Miami home, allegedly a murder-suicide. A note left behind outlined their concern of being moved into a residential aged care facility. Their daughter had allegedly planned to relocate them from their Gold Coast unit to a residential care home in Victoria due to their declining health.     Tropical Cyclone Alfred has not yet hit land in South East Queensland and Northern New South Wales, but it has already started to wreak havoc, lashing coastal towns along the border of the two states. High winds, heavy rains and dramatic swells are expected to cause widespread flooding and destruction to people’s lives and properties. Many people are already worried about claim disputes with insurance companies when the clean up starts and they need to rebuild their homes and businesses.     As Southeast Queensland and Northern New South Wales brace for Tropical Cyclone Alfred, many people will not just consider the practical precautions they can take to prepare for the storms, but also contemplate if they are fully protected by their home and building insurance should they need to make a claim in the aftermath of the extreme weather event. The timing of Cyclone Alfred coincides with the three-year anniversary of another extreme weather event; the floods which devastated Lismore, the small NSW town on the border with Queensland. After the waters had receded in Lismore, many residents reported facing an up-hill struggle to restore their homes, faced with protracted battles with their insurers.     Attwood Marshall Lawyers’ Estate Litigation Partner, Lucy McPherson, was recently invited to speak on The Australian's renowned, true crime series, the ‘Bronwyn Podcast’ with Hedley Thomas. The Bronwyn Podcast investigates the disappearance of 31-year-old Bronwyn Winfield from Lennox Head. Bronwyn was a devoted mother of two young girls and was going through a painful separation from her husband, Jon Winfield. Jon has always maintained Bronwyn just went away and denies any wrongdoing. He is the executor and trustee of her estate. Lucy spoke with National Crime Correspondent, David Murray, for episode 23; Will Power. The podcast questioned whether Jon breached his obligations as executor of the Will of another woman, Beverley Brooker, who left him a multimillion-dollar inheritance, by delaying a payment to a second beneficiary. Lucy explained if it was Jon Winfield's responsibility to inform other beneficiaries that Beverly had died and that her cousin was a beneficiary. Lucy said, "It is the executor's obligation to ensure that all beneficiaries receive what they are entitled to under the Will, and this is part of the executor's responsibility to administer the estate in accordance with the law and in accordance with the terms of the will." "The Supreme Court has the ultimate oversight to ensure that executors and trustees act appropriately and in accordance with their legal obligations and their duties."   • Attwood Marshall Lawyers are proud to support our friends at Coolangatta SLSC, with their family fun day on Sunday 9 March, in aid of one of the club’s members, 13-year-old Miley. Miley, a dedicated young lifesaver at the club, was recently diagnosed with T-Cell Acute Lymphoblastic Leukaemia (T-ALL), a rare, aggressive blood cancer. Miley received her diagnosis on 20 December and just four days later on Christmas eve, she began intensive chemotherapy. Miley and her family now face a tough two-year treatment journey, including frequent hospital stays in Brisbane. Coolangatta SLSC’s fun day starts at 10am and will include a raffle with tickets just $10 and prizes worth more than $8000, a bake sale and a ‘Shave for Miley’ where community members will shave their heads and beards to raise funds for Miley’s family.
