Compliance Update: Judge Blocks DOL Overtime Rule Nationwide?? A federal judge struck down the Department of Labor’s (“DOL”) overtime rule nationwide. The judge halted the DOL's ruling to substantially raise the salary threshold for the white-collar overtime exemptions (Professional, Administrative, and Executive). The court ruled that the DOL exceeded its authority by raising the salary threshold to $43,888 in July and $58,656 on January 1, 2025. The judge not only struck down the second increase to $58,656 set to take effect on January 1, 2025, but also blocked the first increase that took the salary floor to $43,888 in July, and the automatic three-year adjustments, which sets the threshold back to roughly $35,568.?Please note that several states have higher salary thresholds. The DOL may appeal the ruling, but with the incoming change in administration, we cannot predict the chances of an appeal or its success. ? Did you already raise salaries in July 2024? You have several options if you raised employee salaries or converted employees to non-exempt status on July 1, 2024. You may have the legal right to revert the employee compensation structure. However, rolling back the changes now may result in employee discontent.?If you decide to revert employees, please note that several states require advance notice of wage changes. Regardless, we recommend notifying employees in writing before making the change. You may also choose to retain employees at the new level or current non-exempt status because the salary threshold is a minimum level, and employers can always opt to pay exempt employees more. Also, non-exempt status is the default standard for employees. Therefore, you can maintain non-exempt status for reclassified employees.
