We are encouraging the to focus on ensuring trustees gather and analyse data for better claimant outcomes. ?? This is part of our multi-year project to enhance trustee administration and member contact centre practices. An industry review report with detailed insights is expected in early 2025. ?? ASIC is committed to holding the sector accountable. Last week, we initiated civil penalty proceedings against United Super Pty Ltd for alleged member services failures. ?? National Australia Bank (NAB) failed 345 of its customers at their most vulnerable when they applied for hardship support from the bank, according to documents filed by ASIC in the Federal Court today. ASIC alleges that between 2018 and 2023, NAB and its subsidiary AFSH Nominees Pty Ltd did not respond to 345 hardship applications within the 21-day timeframe required by law. We have begun proceedings against Cbus alleging systemic claims handling failures. More than 10,000 members and claimants were allegedly impacted by delays with death benefits and total and permanent disability insurance claims, which took more than 90 days to be processed. We allege that from September 2022, United Super, the trustee of the Construction and Building Unions (Cbus) Superannuation Fund, failed to act efficiently, honestly and fairly in its handling of these claims. We have released a draft regulatory guide on the sustainability reporting regime for consultation with stakeholders. Commissioner Kate O’Rourke said: ‘Our focus for this regulatory guide is to assist preparers of sustainability reports to comply with their obligations so that users are provided with high-quality, decision-useful, climate-related financial disclosures that comply with the law and the sustainability standards.’ Feedback on the consultation is due by 19 December.
