HORIZON SCANNING - Why You Need to Broaden your SCOPE If you work in a regulated industry, you already are hyper-focused on monitoring legislative and regulatory (and enforcement) developments that impact your business. You probably already are scanning daily news feeds and feeds from your key regulatory agencies. If you dont already, you probably should start scanning White House executive orders, presidential actions, statements, fact sheets and remarks. Maybe you're even checking websites for Governors known for using the stroke of their own "sharpies." Legislatures move more slowly, but bill tracking is growing more important to charting your path on the horizon, especially in areas where they perceive gaps to fill like consumer protection, digital assets, privacy and artificial intelligence. But all of this may not be enough. If you work in an industry or sector, such as banking or the capital markets, where agency leadership is changing more slowly, you may benefit by training your binoculars on other sectors where permanent leaders are now installed and moving quickly to issue their own directives implementing the new President's orders. Reading these agency directives could surprise you and reveal how agencies will use their authorities to support the President. By example, the new Secretary of Transportation, Sean Duffy was sworn in on January 28th. DOT does a lot of important things, including funding building and repairing roads through its Capital Investment Grant program. The day after being sworn in, Secretary Duffy issued two executive actions, one of which was to "Rescind 'Woke' DEI Policies and Advance President's Economic Agenda." In the memorandum detailing this action, he orders staff to take immediate steps to update and reset "principles and standards underpinning DOT's policies, programs and activities." Parts of the order relating to rescission of DEI policies. Neither of these parts was particularly surprising, but other parts were more interesting. Towards the end of his memorandum, Secretary Duffy directed that DOT policies, programs and activities not be used to further local objectives and goals unrelated to a "proper Federal interest." To the extent practical, he directs that DOT give preference to communties with marriage and birth rates higher than the national average (including in administering the Federal Transit Administraiton's Capital Investment Grant program)" https://lnkd.in/gWyqeJer

Fed Bank Regulators Announce Regulatory Review - Public Meeting March 6th Separate and apart from President Trump's executive orders freezing rulemaking and ordering a regulatory review, federal law already requires banking regulators to review their regulations at least once every ten years and issue a joint report to Congress. Under existing law, the agencies organize their regulations into categories and schedule four separate review and comment periods. The third iteration of this review under the Economic Growth and Regulatory Paperwork Reduction Act started in 2024 and continues. (The National Credit Union Administration conducts a review of its regulations at the same time; the CFPB is required to do the same every five years under a separate process) Details on their next public meeting were press released today with a link to Federal Register notices containing the regulatory review categories and more details
