Arnett Law Group is pleased to announce a successful outcome for their client! On July 26, 2023, Arnett Law Group, LLC appealed a Circuit Court of Cook County decision granting summary judgment in favor of wholesalers in a breach of implied warranty claim. The Circuit Court concluded that their client failed to provide the wholesalers with pre-suit notice, pursuant to UCC §2-607(3)(a). On appeal, Arnett Law Group argued that the Circuit Court of Cook County erred in granting summary judgment on behalf of the wholesalers, and further erred in the court’s denial of Arnett Law Group’s Motion to Reconsider. The First District Appellate Court ultimately reversed the circuit court’s grant of summary judgment in favor of the wholesalers, based on a lack of §2-607(a)(3) notice requirement and remanded the matter for further proceedings on the breach of warranty claim. On April 23, 2024, the Federal Trade Commission issued a ban on noncompete agreements, rendering it illegal to (a) enter into or attempt to enter into a noncompete with a worker; (b) maintain a noncompete with a worker; or (c) represent to a worker, under certain circumstances, that the worker is subject to a noncompete.
