Yesterday the California Department of Cannabis Control put out a handy primer on the embargo protocol they've been relying on to create a counter-narrative in response to the LA Times Articles. Here it is: https://lnkd.in/g7rxTVzt What they don't tell you is that the embargo regulations lack necessary due process protections that allows the DCC to take your property or even shut down your business entirely without any right to a hearing until and unless they decide to condemn the embargoed goods. We have heard horror stories where 80% or more of the inventory of a cannabis business is embargoed for months, basically destroying the business, without any right to a hearing prior to the taking. Don't let this happen to you! In the spirit of fair play, here's a secondary list of tips for handling embargoes: 1. During inspections you must provide the DCC with access to all books, records, surveillance footage, the facility, etc. However, you do NOT have to submit to interviews or allow your employees to submit to interviews. Never submit to interviews without counsel present! 2. If you receive an initial embargo notice, which can be verbal or in writing, immediately request a supplemental written notice, which must be detailed, and continue to request the supplemental written notice every day until you get it. 3. If the supplemental notice provides you with the opportunity to explain or correct the alleged violation(s), do so as soon as you possibly can and request a date by which you can expect a response. If you have concerns re: any explanation you want to provide, contact an attorney for assistance. 4. Be vocal about the harm to the business caused by the embargo. Remind them every day the embargo continues. 5. If the embargo is over all or nearly all of the cannabis goods held by the business, immediately contact an attorney who can help you protect your rights to due process.
