Arbitration Lab is a Swiss-British initiative bringing evidence-based analysis, big data and online technologies into the teaching, research and practice of arbitration. It conducts and supports events, publications and learning of international arbitration from a comparative perspective. Arbitration Lab brings together top experts on private and public adjudication from a variety of arbitration branches to transfer knowledge, skills and facilitate networking between senior and junior arbitration professionals. Launched in Basel, Switzerland by former classmates at Harvard Law School, who are now academics at leading Swiss and British academic institutions, Arbitration Lab plans to conduct training and conferences, research projects and work closely with dispute resolution institutions and legal practitioners. Its two flagship initiatives include a winter school in Basel and a summer school in London.

    As part of the 2025 Basel Winter Arbitration School, Sophie Grémaud, in-house counsel at Sotheby’s, delivered a keynote on arbitration in the art market. The keynote video is now available online. It was moderated by Anna Petrig and Yarik Kryvoi. The keynote explored the distinctive features of the global art market, a vibrant and highly international sector valued at approximately USD 65 billion in 2023. Sophie Grémaud, a seasoned international dispute resolution lawyer, provided a comprehensive overview of the legal challenges that arise in this dynamic industry. Topics included the complexities of authenticity disputes, provenance issues, and cultural heritage concerns, among others. Drawing on notable cases like Maria Altmann’s restitution claim for Nazi-looted Klimt paintings, the Knoedler forgery scandal, and disputes over works like Salvator Mundi, the lecture illustrated how arbitration could provide a confidential, efficient, and specialized forum for resolving such conflicts. By examining real-world examples, the keynote highlighted arbitration’s potential to address the complexities of cross-border claims, balance public interest with confidentiality, and foster innovative solutions in the evolving legal landscape of the art world. Additionally, Sophie delved into the various initiatives aimed at promoting arbitration within the industry, such as the Court of Arbitration for Art, where she is listed as an arbitrator. The keynote also touched on broader trends and the future of dispute resolution in the art market, considering the impact of technological advancements and globalization.     In this paper just published by BIICL (British Institute of International and Comparative Law), I examine what it means to be a good lawyer and how to train essential legal skills. I thank senior legal practitioners, colleagues and friends based in London, Washington, D.C., Hong Kong, Kyiv, and Riyadh who shared their thoughts on the topic including: Nicholas Lawn (LALIVE), Dr Johannes Koepp (Baker Botts), Din Eshanov (White & Case LLP), Matthew Hodgson (A&O Shearman), Hussein Haeri KC (Withersworldwide), Pavel Shevtsov (A&O Shearman), Michael Sabin (Clifford Chance), Olena Perepelynska (INTEGRITES), Danielle Morris (WilmerHale), Evgeniya Rubinina (Enyo Law LLP), and Audley Sheppard KC (Twenty Essex). Key findings: ???? For centuries, law was not a formal “taught profession.” In jurisdictions like England, practical training through pupillage or training contracts was sufficient to qualify as a lawyer. Today, however, legal education faces increasing criticism for its detachment from real-world practice. Graduates often have strong theoretical knowledge but weak practical skills, a gap made worse by the rising costs of legal education. This leaves firms to subsidize much of the practical training at the beginning of lawyers' careers. ???? This issue transcends legal traditions. In both common law systems and civil law jurisdictions, students are trained with a focus on case law or statutory interpretation. However, the rise of globalization has led to the growth of a transnational legal profession, with international firms shaping global practices. ??????? Interviewed legal practitioners emphasize seven adaptive skills that every lawyer needs: analysing complex facts, identifying critical legal issues, applying relevant laws contextually, assessing strengths and weaknesses, generating client-focused solutions, and presenting these effectively. ?????? To bridge the gap between education and practice, legal education needs to be more hands-on. Incorporating real-life scenarios, such as moot courts and simulations, and involving practitioners in teaching can enhance the learning experience. Flexible online courses can also cater to the busy schedules of practitioners. ?????? By fostering "adaptive expertise"—an approach found in fields like medicine—lawyers can engage in lifelong learning, adapt to new challenges, and continually refine their skills.
