ABC Texas had a BIG week at the Capitol this week advocating for the merit shop and pushing forward key priorities for our industry. A huge thank you to board member Josue Reyes from D. Wilson Construction Co., who flew in to testify in support of HB 1992 by Rep. Jay Dean, our bill to address the accrual date issue with Right to Repair and bring more fairness to the construction legal process. Josue's real-world experience as a contractor brought powerful, practical insight to the committee. Our Director of Advocacy & Outreach, Ana Grace Husted & Andrews Myers, P.C. Carson Fisk, FCIArb, also testified on HB 2960 by Rep. Richard Hayes for Texas House — one of ABC’s top priorities this session—which would ensure contractors are no longer forced into unfair out-of-state venues through contract clauses. And in even bigger news, SB 936 by Senator Kelly Hancock, our top priority bill to expand the state’s prohibition on government-mandated PLAs, passed the Senate floor with a 20-11 vote. This is a major step forward for protecting free enterprise in Texas construction. After one final procedural vote tomorrow, we will see it move to the House for next steps. We’re proud to stand up for Texas contractors and merit shop principles at every level. BIG congratulations to firm shareholder William "Bill" Erwin's family on their award-winning craft distillery - Andalusia Whiskey Co. - winning "World's Best Small Batch Single Malt" for their Stryker single malt whiskey at the World Whiskies Awards (WWA) last night in London! The WWA released their list of the world’s best single malt whiskies, and the winners are an eclectic mix of distillers from Scotland, the US, and Sweden. Andalusia Whiskey Company’s Stryker Ex Haak Madeira Cask Finished Single Malt was awarded the World’s Best Small Batch Single Malt in the competition. The craft distillery in Blanco, Texas is known for producing a range of American single malt whiskies, combining traditional methods with innovative aging techniques to create unique flavor profiles. Congrats to you Tommy Erwin and your Andalusia Whiskey team - much deserved!

Austin shareholder Carson Fisk, FCIArb recently testified in support of House Bill 2960, which would amend Section 272.001 of the Texas Business and Commerce Code to more fully support the basic rule that disputes on Texas construction projects should be decided in Texas, under Texas law. As currently framed, Section 272.001 merely makes out-of-state venue and choice of law provisions voidable—not void. And at least one intermediate appellate court has determined that that statutory right to void can be waived by entering into an out-of-state venue and choice of law provision. With broad support from the construction industry, including Associated Builders and Contractors of Texas, AGC Texas Building Branch and the Texas Construction Association, HB 2960 offers enhanced certainty concerning the application of governing law and trial and hearing locations, reduced dispute costs, and the elimination of tactics where these clauses are used as a barrier to efficient and effective resolution as to the merits of a dispute.
