Do you know what the Top Twelve Insurance Coverage Decisions Of 2024 were? In their recent article in LexisNexis Mealey's Litigation Report, Robert Chesler, Seán McCabe, Madilynne Lee, and James Goodridge lay them out. They open by noting: "In 2024, policyholders attempted to find coverage for newly developing torts under general liability policies, but largely without success. Policyholders suffered defeats on coverage for opioids, lead paint, greenhouse gases, and sex abuse allegations, as courts refused to extend the coverage afforded by the general liability policy to policyholders’ evolving liabilities. This is a troubling development, as the protection afforded by the general liability policy is supposed to evolve to match the changing liabilities of policyholders. We expect that 2025 will see continued battles for coverage in these areas." In their new Law360 article, "Appealing An Interlocutory Order On Insurer Duty To Defend", Carrie Maylor DiCanio and Neil Schur review the rules that govern whether an order is immediately appealable in federal court. The pair note, "[b]ased on these cases, there is a good argument that a circuit court has jurisdiction over the appeal of an order denying a motion for an insurance company to defend the policyholder in ongoing litigation where the order refuses to require the insurance company to pay the policyholder's defense costs prospectively." Additionally, the duo outline three important lessons that a policyholder seeking a ruling on its insurance company's duty to defend can draw from recent decisions of several circuit courts.
