Anchor Excellence

The Aged Care Bill 2024 has passed Parliament following a decisive vote in the House of Representatives. With no further amendments proposed, this means the new Aged Care Act will come into effect on 1 July 2025, marking a significant step forward for aged care in Australia. The newly established Aged Care Transition Taskforce is set to meet for the first time this week and will work closely with the sector to ensure a smooth transition to the new Act. In support of this, the Aged Care (Consequential and Transitional Provisions) Bill 2024 was introduced last week. This Transitional Bill is crucial for facilitating the shift from the existing legislative framework to the new Act, ensuring continuity of care throughout this period. Key changes include: - Continuity of Approved Provider Status: Current approved providers will be transitioned as registered providers under the new Act unless deemed inactive by the System Governor. - Registration Periods: Registered provider periods will range from 3 months to just over 3 years, addressing concerns about regular reassessment raised by the Royal Commission. - Pending Applications: Applications pending approval before transition will be processed under the new legislative framework. - CHSP and NATSIFAC Providers: These entities may be deemed registered providers under the new Act. Removal of Freedom of Information Exemptions: Implementing Recommendation 88 from the Royal Commission, previous exemptions are repealed, granting access rights to information. - Obligations for Reporting and Notifications: Existing requirements remain effective through transition. - Sanctions and Record Retention: Sanctions transfer under the new Act; records can be maintained according to prior laws. Additionally, transitional rules may be made by the Minister to address specific circumstances not covered by existing provisions. These developments promise enhanced regulatory models, strengthened quality standards, and easier access to services for older Australians. The Support at Home program also ensures more seniors can live safely in their homes longer with necessary modifications.
