Michigan's Earned Sick Time Act (ESTA)?& Minimum Wage Update The Michigan Legislature just amended the Earned Sick Time Act (ESTA) and the Minimum Wage Act. Here’s what you need to know: Earned Sick Time Act (ESTA) Updates: 1. Small businesses (<10 employees) have until Oct. 1, 2025, to comply and only 40 hours paid time off needs to be provided 2. Employers can frontload PTO instead of using an accrual system 3. Nonprofit agencies (503(c)) are exempt from the law 4. Employers can establish procedures for call in that employees must follow. 5. CBA-covered employees have different waiting periods & rules 6. New penalties for non-compliance: up to 8x an employee’s hourly wage in fines 7. 30-day grace period to post new posters 8. Shortest earned sick time off can be taken in one-hour increments 9. Private lawsuits are no longer allowed New Michigan Minimum Wage Schedule: 1. Feb 21, 2025: $12.48/hour 2. Jan 1, 2026: $13.73/hour 3. Jan 1, 2027: $15.00/hour 4. Tipped wage gradually increasing to 60% of minimum wage by 2035 ASE will provide more information on the amended laws as it becomes available.
