    Trump’s Press Conference and the Future of EB-5 We are closely monitoring the situation following President Trump’s recent press conference, where he announced a potential "Gold Visa" program. The Gold Visa commands a $5 million price tag without the job creation component of the EB-5 program. While there is still much we do not know—how the Gold Visa program will be structured, whether it will be added as an additional visa category, or if it will replace EB-5 altogether—one thing remains clear: speculation should not distract us from the facts we do know. ✅ The EB-5 Regional Center Program remains authorized through September 2027 and cannot be abolished by executive order. ✅ The EB-5 Reform and Integrity Act of 2022 (RIA) implemented critical investor protections, including "grandfathering" provisions that safeguard those who file before September 30, 2026. ✅ The RIA also introduced stringent anti-fraud measures to increase transparency, enhance accountability, and remove bad actors from the program. What This Means for EB-5 Investors: At this time, there are no changes to EB-5 law or procedures. Investors should continue to follow the advice of and closely work with their immigration counsel to progress their permanent visa applications. Additionally, any attempt to modify or eliminate the program would require congressional action and would likely face legal challenges. Looking ahead, our industry has its work cut out to ensure the EB-5 program remains intact through 2027 and is ultimately reauthorized. We remain steadfast in our commitment to preserving and strengthening the program for investors and stakeholders alike. We will continue monitoring the situation and providing updates as they become available. Reserved EB-5 visa categories, created under the 2022 EB-5 Reform and Integrity Act (RIA), offer unique opportunities: * Reduced $800,000 investment thresholds * Concurrent adjustment of status benefits, including 5-year renewable work and travel authorization. * Current visa availability for all countries in these categories—for now. 📊 Key Facts About Reserved EB-5 Visas 1️. Mayorkas - Path of Funds Clarity This afternoon, IIUSA hosted an important webinar regarding recent litigation spearheaded by Ron Klasko regarding investor path of funds. The recent D.C. federal court ruling in Battineni v. Mayorkas provides critical guidance on the EB-5 path of funds requirement: Case Overview: Investor's $500,000 EB-5 investment included $40,000 gifted from a friend who works for the U.S. government. USCIS denied the petition, arguing the investor didn’t sufficiently trace the funds through every prior transaction. Court’s Decision: The court ruled that while a lawful source of funds is required, USCIS overstepped by demanding exhaustive documentation for the entire “path of funds.” The law only requires proof of the immediate source—ownership and control of the funds—not every historical transaction. Key Takeaways: Investors may not be required to trace funds down to every penny for decades-old transactions. However, if the documentation is available, it is advisable to provide as much evidence as you can. This decision could reshape how RFEs and NOIDs on source/path of funds are handled. It’s a strong precedent, though not binding nationwide—yet it’s likely to influence other courts and future cases, particularly if the case makes it to the DC appellate courts. Impact on EB-5 Cases: This ruling can help address past denials within the statute of limitations, inform interfiling for RFEs/NOIDs, and bolster cases where proving long financial histories is impractical.
