BREAKING: AFA Action joins volunteer fire departments and first responders in opposing absurd OSHA rule! AFA Action Senior Legal Fellow Trey Dellinger testified before OSHA on the agency’s proposed emergency response standard. The proposed rule would require virtually every employer or volunteer organization with an emergency response team to follow absurdly burdensome new regulations. The requirements include comprehensive site assessments, the development of a written emergency response plan, mutual aid agreements with other employers or professional emergency services organizations, and the adoption of a comprehensive risk management plan. The proposed regulation would force small employers to provide personal protective equipment, conduct employee fitness qualifications and testing, and even require periodic monitoring of emergency response team members’ health. This is only a partial list. “OSHA’s proposed emergency response standard is a cost-prohibitive, one-size-fits-all unfunded employer mandate that will make workers and the public less safe,” said Dellinger. “The proposed rule does not require employers to have an emergency response team, but if they do have one, they must shoulder these prohibitively expensive regulations. Many employers, like churches or volunteer fire departments, will simply disband their emergency response efforts, making communities across the country less safe. This is yet another poorly thought-out Washington mandate, much like the Obamacare coverage mandate or the COVID-era vaccine mandate.” Dellinger joined other witnesses in urging the OSHA panel to abandon the proposed rule. These include volunteer firemen and law enforcement officers from around the country. “OSHA’s statutory responsibility is employee health, not emergency response,” explained Dellinger. “The proposed rule is unreasonable and dangerous, applying the same requirements appropriate for a giant industrial plant to a small country church security team. That makes no sense. AFA Action urges OSHA to pull the plug on the proposed rule and either leave the matter to Congress or adopt different rules for different types of employers. Churches and nonprofits should not be under the same safety rules as large factories.”
