Today, I participated in a panel at the University of Maryland and discussed the impact of the recent election on U.S. immigration law and policy. It is no news that the Trump 2.0 administration is expected to bring about a major policy shift on immigration. While a lot of the talking points in the media have been about the border and the humanitarian side of immigration law, we anticipate broad and sweeping changes affecting immigration applications across the board, including employment-based visas and green cards. At a minimum, we can expect the following: ?? Extreme vetting across all categories of immigration benefits and employment-based applications. ??Significant increases in processing times (likely doubling) as finite resources are redirected towards enforcement. ??Higher rates of Requests for Evidence (RFEs) and denials, including for meritorious applications, with decisions giving less deference to precedent. ??New and restrictive policy guidance at USCIS. ??Longer processing times abroad at U.S. Consulates, higher denial rates, and an increase in 221(g) issuances (i.e. administrative processing, but also a catch-all commonly used in lieu of denials, resulting in cases stuck in limbo for months, even years). ??Executive orders aimed at rapidly implementing immigration policies without relying on Congress. It’s not just the border. International students, folks in STEM, outstanding researchers, persons of extraordinary ability, multinational, as well as U.S. companies will feel the effect of this shift. Given these anticipated changes, it’s important to consult with an immigration attorney and have a strategy ready.
