The lawsuit alleges that the healthcare provider used tracking technologies to share patients’ sensitive health information with third parties like Facebook—without proper consent. The Court upheld claims under the Electronic Communications Privacy Act (ECPA) and for negligence under Illinois law.? We welcome the Court’s decision and are committed to moving this case forward. ALG FOUNDER DAVID ALMEIDA APPOINTED CO-LEAD INTERIM COUNSEL IN CONSOLIDATED CLASS ACTION LAWSUIT AGAINST CITYMD Magistrate Judge Cathy L. Waldor of the United States District Court for the District of New Jersey recently consolidated two pending class action lawsuits against Summit Health LLC d/b/a CityMD. The lawsuits, which will now proceed together under the caption In re CityMD Data Privacy Litigation, allege that CityMD, a provider of urgent care services, utilized tracking technologies on its website to disclose certain sensitive information to third party adtech companies (such as Facebook and Google) without informed consent. Magistrate Judge Waldor appointed David S. Almeida of Almeida Law Group LLC, Blake Yagman of Sterlington PLLC and Joseph J. DePalma of Lite DePalma Greenberg & Afanador LLC as Interim Co-Lead Class Counsel. The Court’s December 17, 2024 Order provides that Interim Co-Lead Class Counsel shall be responsible for, among other things, coordination of all pre-trial activities, conducting discovery on behalf of Plaintiffs consistent with the requirements of Federal Rule of Civil Procedure 26, supervising the work of all Plaintiffs’ counsel and conducting settlement negotiations.
