Physician and hospital groups are voicing frustration after a Texas court ruled that decisions under the #NoSurprisesAct (NSA) are “unenforceable,” leaving providers without recourse to collect payments they are owed from insurers. This ruling means even if providers win disputes through the Independent Dispute Resolution (#IDR) process, insurers are not obligated to pay in the state of Texas. Without enforcement, the IDR process will become useless, as insurers will lack accountability for paying awarded amounts.? No source of recovering on insurance underpayments can lead to? reduced access to critical care, especially in rural areas Congress must implement enforcement provisions to ensure fair #reimbursement and preserve the integrity of the IDR process. The Healthcare Justice Coalition, an organization which collaborates with #HealthcareProviders to ensure fair payment from #HealthInsurers, filed a lawsuit in Ohio state court on January 30th, 2024 against Aetna to pursue payment for services owed to #EmergencyDepartment physicians. Aetna attempted to remove the case based on three arguments: the #NoSurprisesAct (#NSA), #ERISA, and diversity jurisdiction. However, the judge rejected all of Aetna's arguments and remanded the case back to Ohio state court. Key points from this case: ??The court rejected Aetna's NSA interpretation, stating the NSA lays out an optional #IDR process that defers to state law for payment disputes. ??ERISA preemption was dismissed as irrelevant since claims were for payments to providers, not patients. ??Aetna’s argument that Meritain, the health plan administrator, wasn’t an insurer was rejected, with the court concluding Meritain had obligations for the services provided. This allowed HJC to defeat diversity jurisdiction. We believe the specific decision regarding the NSA is highly remarkable—while this was a position the plaintiff had maintained from the beginning, we have not seen any decisions with this level of clarity directly on point.? This ruling is a battle won for #EmergencyPhysicians in the war to hold big #HealthInsurance accountable. It is a reminder that deference to state law is achievable when pursuing this type of litigation #HealthcareLitigation has the power to systemically level the playing field by challenging entrenched practices.
