Arielle Roth, nominated to lead the National Telecommunications and Information Administration (NTIA), testified before the Senate Committee on Commerce, Science, and Transportation on March 27. If confirmed, Roth will oversee the $42.5 billion Broadband Equity, Access, and Deployment (BEAD) program. During the hearing, senators from both parties questioned Roth about various aspects of the program. Roth committed to administering the BEAD program impartially, stating she would serve the American people without favoring any individual or company. Senate Committee Chairman Ted Cruz praised Roth's dedication and experience in telecommunications policy. The committee will soon schedule a vote on Roth's nomination. In 2024, over 82% of U.S. antitrust agency merger enforcement actions involved either a litigated challenge or an abandoned deal. But with only 17 total enforcement actions announced, agency press releases leave out a significant portion of merger review activity—including many Second Request investigations that never make headlines. ? To bring greater clarity to this space, Akin has launched the Agency Transparency In Merger Enforcement Report— a comprehensive, data-driven look at extended merger investigations going back to 1996. The report captures both public enforcement actions and investigations disclosed by merging parties, offering a clearer picture of what companies can expect in today’s antitrust environment. ? ?? The SEC has abandoned its defense of the climate disclosure rule, citing concerns over costs and intrusiveness. This decision means public companies will no longer be required to comply with specific climate-related disclosure requirements, potentially reducing regulatory burdens. In a recent enforcement action, the UK's Office of Financial Sanctions Implementation (OFSI) imposed a £465,000 penalty on Herbert Smith Freehills CIS LLP Moscow (HSF Moscow) for sanctions breaches. Notably, the initial penalty of £930,000 was significantly reduced by 50% due to HSF London's prompt and detailed voluntary disclosure and full cooperation with OFSI. This case underscores the critical importance of proactive compliance and the significant benefits of voluntary disclosure and cooperation in mitigating penalties. Companies must ensure they understand their sanctions risks and implement robust measures to prevent breaches. The FCA is increasingly moving away from formal enforcement action towards less traditional "assertive" supervisory intervention. This includes the use of Voluntary Requirements (VREQs), which can have immediate and substantial impacts on firms. Proactive compliance and risk management are now more crucial than ever.
