Remember those erroneous notices for late filings of Form 8955 SSA you may have received this year??We have a client that received the late 8955 notice from the IRS (in error) and the IRS deducted the erroneous penalty from their 1120 corporate refund.?Their tax team called the IRS and the IRS stated they were aware that any refunds due for other filings would have been offset by this erroneous penalty.?The IRS stated they will now be going through all filings one by one to confirm which notices were erroneous.?The IRS did not know how they would correct this (issue a check for the erroneous offset or if they would send out a letter asking if the taxpayer wanted the refund, or have it applied to another tax due).?They could also not provide a timeframe. ? If you received this same late filing notice for your 8955 SSA Form, you may want to notify your tax department in case any federal refund you are due was also erroneously reduced. ?
