It is relevant to establish a formal subcontractor assessment to properly choose the ones that are compliant with the expected standards, and also formally communicate them, being part of the contract.

Develop a subcontractor management Plan which starts from the sub contractor selection. Review previous EHS performance history their EHS policies and plans. Safety requirements must be basic obligatory terms of the contract. Include feedback questionnaire in OHS orientation to assess its effectiveness. The OHS Plan and procedures must be formally shared with sub contractor formally to ensure compliance. Conduct daily & weekly inspections, trainings, joint TBTs, EHS walkthroughs, Emergency drills. Implement an incident reporting and investigation system. Develop a schedule for regular safety meetings. Implement an incentive and disciplinary action policy. Ensure periodic safety EHS performance reviews and share feedback in review meetings.

I find putting it in the contract as an enforceable point brings it together. This way no questions come up for anybody. Making sure it’s clear and understandable is just as important.

Regular compliance checks are very necessary to ensure contractors comply to the contractual safety requirements. Weekly safety meetings are also another way to ensure compliance. Safety Observations are discussed at these meetings and identified gaps are followed up for close out.

Continuous monitoring , evaluation and consequence management are key steps to reinforcing established safety protocols in a workspace. Evaluation could take the form of on the job inspection of the subcontractors in line with, work authorization, use of PPE, and following the SOP as required.

It is always better to maintain a clear communication hierarchy to avoid any confusion. While it’s important to ensure adequate communication with the ground team, it’s preferable to relay important information to superiors rather than directly to the ground team.

Communication is also the main aspect for clear and transparent information about safety. For the contractor the communication line should be clearly from top to bottom.

My pre-qualification process gathers data and spends time with contractors to verify their safety culture and commitment is aligned with mine. Only contractors with excellent safety cultures and programs are able to bid on projects. The project goals are aligned to recognize excellent safety performance along with schedule and budget performance.

Contractors continually face the challenge of working for host employers with very different safety cultures. They might be working for a company this week with very lax safety requirements. Next week they can be in an environment with an inconsistent culture that varies with the next deadline. It’s important that host employers and general contractors set strict and consistent accountability with their contractors to communicate the message right at the start that safety is a non-negotiable. Require that violations of critical life safety rules or repeat instances of safety violations have swift, significant consequences, like removing the offending employee immediately and requiring remedial action by the contractor.

Considering my years of experience in this industry, to have a holistic control on hse within sub contractors wouldn’t happen unless the health and safety requirements are clearly stated in the contract. The more descriptive and specific it is the better the bid would be and the better their preparedness be. From what I have seen is, there is a tendency in few countries where i have seen where in the contractors are written in ambiguity and then expect the safety culture to kick in. What happens in this scenario is it depends on the people who oversees the contractors and his competence in managing them and the inherent hse culture of the company as such. Let’s leave less to the intangibles and let’s go for clarity.

1.Contractual obligation should be backed with an agreed safety plan and the standards adopted, either local or internationally recognized standards ,including the sentence " Which ever is better or safer". 2.The agreement should also details the authority of the job owner on the contractor in case or non-compliance, this authority must also be detailed in numbers of warnings and durations permitted for compliance. 3.The contract must refer to legal requirements of complying to safety, to give authority to the job owner to take action if needed. 4. The law or standards do not indicate the actions or authority of the job owner on the contractor, therefor these details must be covered in the contract.

When formulating contracts with subcontractors, it is essential to incorporate comprehensive safety requirements along with the repercussions for non-compliance. It should be explicitly stated that compliance with safety protocols is mandatory and that the continuation of their contract is dependent on their safety performance. This legal structure establishes a formal expectation regarding safety and serves as a foundation for initiating actions should subcontractors fail to adhere to safety standards.
