You're dealing with conflicts in education. How can you ensure a successful mediation process?

Again, in whatever document controls the parties, there should be a mediation and even an arbitration clause. I'm assuming most conflicts of these types are parent vs. teacher concerning one of the kids in K-12. The main issue, of course, is that all parties should be aware that their SOLE method of negotiation and redress.

The need for an advanced technical understanding of the educational issues implicated is nowhere greater than in litigation under Federal laws such as I.D.E.A and Title 9, where the parties have necessarily passed through hours of dialogue during administrative efforts towards compromise before they arrive at mediation. It not infrequently falls to the mediator to assist in redefining the case with an eye towards uncovering new remedies for the educational impasse or casting a new light on remedies or combinations thereof that had been considered earlier, but rejected by one side or another. The mediator cannot bring anything impactful to either process without an astute understanding of the educational issues peculiar to the case.

If you want to be trusted you need to be trustworthy. When you can be trusted to be in the role by both parties, you can hit the pain points in a way that limits offense and gets on with the business of unification.
