Caso concreto: pessoa acometida com a doen?a chamada de osteoporose foi ao médico que prescreveu como tratamento necessário ao combate a doen?a relatada o medicamento chamado ACLASTA. O medicamento é aplicado por via intravenosa 1 vez por ano no pronto atendimento de um determinado hospital. A operadora de plano de saúde negou o medicamento .Sendo assim, ela me procurou e ingressamos com a a??o judicial contra a operadora de plano de saúde. A justi?a determinou que a operadora liberasse e aplicasse a medica??o na senhora, bem como condenou a operadora do plano de saúde em danos morais, tendo em vista a ilicitude cometida e as viola??es contra os direitos da consumidora.
