How do you monitor and measure contract performance and outcomes?

Contract management requires careful attention to the details of the needs of both parties, clarity in communication, and defining well-crafted terms. The requirement is to ensure that all the terms of the agreement are well-defined, including performance metrics aligned with business objectives, and properly documented. Through this process, organizations can minimize risks, enhance compliance, and maximize the performance outcomes derived from the contracts. The lifecycle of the contract involves the process of creating, executing, and monitoring contracts to ensure that all parties involved comply with their obligations and achieve the desired outcomes, in order to avoid misunderstandings, disputes, and delays in contract execution.

In addition to traditional lagging indicators that measure outcomes, consider incorporating leading indicators that provide early insights into progress and potential issues. This forward-looking approach can help you take proactive measures and make timely adjustments to optimize contract performance.

In my experience establishing key performance indicators (KPI) that aligns with the contract objectives and basic requirements is one of the best ways to monitor contract performance. These KPI's should be specific, measurable and agreed by both parties. Then follow the usual steps like regularly monitor KPI's, analyze data and then communicate the findings between the parties. If there are deviations compared with set parameters, take corrective actions.

I think there are several types of contract management. Of course, there's the legal aspect. Contracts have defined terms that have to be adhered to, dates that have to be met. That's what I call the "bones" of a contract. But then I think a contract has "intent". What were the parties trying to achieve? What were the goals? Are those being accomplished or are you hitting brick walls? Every contract can be amended to move the needle closer to the sought-after outcome for everyone. Performance should be measured by the degree of satisfaction and trust the parties to the contract have.

Establish clear metrics and tracking systems to monitor contract progress. Communicate regularly with stakeholders, sharing progress updates and addressing any issues promptly. Document and track issues, risks, and changes for accountability and future reference.

Sometimes, the contract owner or administrator is not the same as the end user. In such cases, both the end user and the contract administrator should work together to monitor performance of the contract against agreed goals and milestones. Also, the importance of regularly scheduled feedback sessions with the Contractor cannot be overemphasised. During such sessions, past learnings can be reviewed and potential issues spotted.

Modern contracts can be described as a transition 'Beyond Words, Into Numbers'. Instead of just words, they're now about numbers. Using the SMART framework helps everyone be clear about what's expected. It is more than just adopting an acronym; it's a tool of partnership based on concrete, quantifiable benchmarks. By establishing both baseline and targeted KPIs, we make the intangible-tangible. This is where technology tools and data analytics come in, performance isn't just passively observed but actively predicted, monitored, and analyzed in real-time. Leveraging SMART framework with technology isn't a mere change; it's a revolution in understanding and managing commitments and build smart, sustainable, strong partnerships.

To ensure the contract milestones are being achieved on time, on budget and quality standards are being met, the contract manager should create a milestone register and regularly monitor the performance of each milestone and not wait until the end of the contract to measure its performance. This is because if there are any delays or changes you can report to management in a timely manner to manage risk.

The contract progress must be managed dynamically but should also not be unrealistic. It is important to track progress and deploy improvement tools based on the type of service and it's ability to be readapted.

Predefined milestones can certainly manage ultimate trajectory. Many abstract measures certainly require a great level of measurable criteria to be able to have them assessed on merits and not feelings or hearsay. The contractor should understand this upfront, at the beginning and this removed any surprises along the way in terms of expectations.

Continuous improvement is the natural progression from feedback. By consistently revising and refining contracts based on feedback, we ensure they evolve with the times and the specific needs of the stakeholders. Gone are the days of static, one-size-fits-all contracts. The future lies in agreements that are malleable, adaptable, and primed for longevity. The most meaningful contracts will evolve. When you start out in a highly collaborative manner with your internal facing stakeholders and your supplier stakeholders aligned to a common goal and a very well defined scope, then there will be optimization of the contract, there likely will be growth, and most importantly it will be highly valuable to both sides.

This should form part and parcel of the objective setting stage. In fact, the contract should be borne out of the organisational strategy, how flexible, agile and service oriented it wants to be. Certainly, if services are outsourced or contracted out, it is an extension of what you would want done had you been doing it in-house.

Assess and mitigate potential risks associated with the contract. Identify potential risks, such as legal, financial, or operational risks, and develop strategies to minimize their impact. Regularly monitor and evaluate risks throughout the contract lifecycle and have contingency plans in place.

In my opinion the success or failure of a contract is often directly related to the quality of the investigation, design, strategy and procurement process(es), the things that occur long before a contract is let. Yet, because it is much easier to judge the last parts of a process, we often point to contract managers and the contractor/supplier when measuring contract performance. Instead we need to critically consider if we, as the purchaser, really knew the outcome we wanted. Did we do a thorough investigation? Was the outcome we sought actually achievable? Were we an informed purchaser? Did we select the cheapest tender without understanding if the works/supply could be actually be achieved for that price?

I think the most important in contract are products’ or services’ quality ,prices, commitments and dates,must be guaranteed through penalties. Contract process should be separated in to 2 steps -Contracts’ administration, to arrange contract initiation and negotiations between involved parties until it signed. -Contracts’ management, to execute , follow up contracts and measure KPIs. Contract language must be clear and simple to avoid any doubt or confusion. Parities better to give them selfs chance to review ,improve and amend contracts when it is necessary or during fixed periods or dates . Termination of contract must be taken in consideration ,parties must review their rights and carefully see how to keep them before signing contract.
