How can you weigh the value of labor unions?

Historically, the labor union has played a significant role in shaping collective agreements and working conditions. I believe that an open and ongoing dialogue with the union is an effective tool to understand where companies can improve or identify redundancies that can be implemented and sometimes there is a gap in this relationship.

These factors are often forgotten. Unions do more than bargain over wages! Protection against abuse in the workplace is a crucial function. So is building skills in interaction with management.

One thing I have found helpful is that employers around the world understand that working with a recognised trade union can bring many benefits to their company. In particular, trade unions can help employers to Build trust among the workforce, Ensure workplaces are safe, Audit non-compliance with labour laws, Promote equality, Make better business decisions and Increase productivity .

Focussing solely on the benefits of labour unions in the development of the body of case law, they are of great importance as most individuals in South Africa do not have the means to take employment disputes beyond arbitration and into the Court system. Unions will drive disputes on behalf of their members. The results of these disputes often have far reaching effects on the field of employment law, changing the status quo within workplaces across the country. Having large, active labour unions within workplaces is one of the main reasons why the field of employment law is so dynamic within the South African context.

To evaluate labor unions' value, consider worker rights, collective bargaining effectiveness, job security, wage and benefit levels, representation, skill development, conflict resolution, economic impact, industry competitiveness, drawbacks, legal environment, and public perception. Assess their role in promoting fair conditions, stability, and a collective voice for workers while weighing potential disadvantages and societal impact. Balancing these factors provides a comprehensive evaluation.

It can be a cost as we allow disputes to spiral out of control or even fail to make a decision at lower levels which then gets disputes to be escalated to spaces beyond the control of parties like Employment courts where awards might affect the profitability of company.

Factors affecting the value of trade unions include union leadership structure, negotiation skills, understanding of business they Organise in, operational resource availability, size and relationship with the members, workplace leadership and management

To be more precise, some factors within the employer's environment that may affect the value of unions are market concentration within the industry (e.g. is the company a monopoly (or, worse for the workers, a monopsony), part of an oligopoly or in a highly competitive industry?) and trade barriers (i.e. is the company competing locally or against the whole World?)

Academic papers were written about the value of labor unions and used econometrics (e.g. John V Winters (2011) found that unions increase salaries for experienced teachers by as much as 28%) and cost-benefit analysis to do so.

Based on my observations, companies tend to abide by labour laws, which means that trade unions are not given much room to negotiate. We can attribute this to their declining membership. Employers are becoming more cognizant of the law as a result of the digital revolution.

One thing to consider is that the Market is most of the time in Arbitrage Scenario I.e. in few instances Labor unions will be advantageous to Society as a whole (including all stakeholder benefits less detriments) while in other instances not so. It is the degree of inequality between the two sides that needs to be minimized or kept in limits
