How can you quickly resolve conflicts in BRM using mediation techniques?

I understand that a good practice is to involve a mediator for an immediate rightful resolution, compassionate approach to manage and retain important resource & placements and uplift organization goodwill and culture.

Professionally, I definitely encourage mediation before arbitration- it’s the best way, in my option, to resolve conflicts, that at times tend to be a result of miscommunication that leads to conflict. Through the mediation, understanding is made clear through coaching - parties are empowered and communication and other soft skill competencies are strengthened. Additional bonus; with mediation things can be kept more confidential and heck it’s free (in most cases) … and who doesn’t mind free.

A key conflict resolution strategy is to recognize that all of us have biased fairness perceptions. Both parties to a conflict typically think they’re right (and the other side is wrong). Our sense of what would constitute a fair conflict resolution is biased by egocentrism, or the tendency to have difficulty seeing a situation from another person’s perspective. We might do this by jointly hiring a mediator who can help us see one another’s point of view, or by enlisting another type of unbiased expert, such as an appraiser, to offer their view of the “facts.”

As a Global Talent Acquisition Director I utilized mediation techniques to resolve a conflict with a business unit which had unreasonable hiring expectations. I first established a neutral ground for dialogue. I facilitated an open discussion, encouraging each party to voice their concerns without interruption. By employing active listening, summarizing key points, and reframing the issues to focus on mutual goals, the I highlighted common interests. I guided them towards collaborative problem-solving, where each manager contributed to a shared resolution path. This approach not only swiftly defused the tension but also strengthened the team's cohesion and commitment to the business unit's objectives.

In any business transaction there has to be a positive consideration for both the sides then only a business is transacted,now at any given time either of the party with some knowledge gained during the course of transaction concluded that more benifits can be squeezed out , will try for the same and this thought process shall give a chance for the conflict. This human psychology of squeezing out more is the main reason of conflicts. To manage this conflict the process of meditation has to start immediately and by a person fully knowledgeable of the terms and conditions of the transaction from the perspective of both/all the parties so as to bring all of them to a common consensus with few diversions from the original matter.

I would say meditation provides a structured process for addressing disputes, which can lead to faster turnaround times and resolutions. It is typically a confidential process, which encourages openness and can prevent the escalation of the conflict. The process is a more collaborative approach, aiming to preserve professional relationships and allow for future cooperation. Mediation can also be generally less expensive and quicker than potential litigation, reducing the financial and time burden on both entities.

Mediation is internal process. Both sides should be encouraged to resolve through mediation which will result in increased trust among employees at all levels.

In my previous job, there was a high-budget project in progress when a major conflict erupted between the IT Head & the project's main expert. The expert was extremely upset and chose to isolate himself in his residential room, neglecting work for two consecutive days. This caused the project to come to a standstill & there was a risk that all the efforts will go to waste if the expert didn't return promptly. The IT Head urgently sought management intervention through mediation to address this critical issue.

Mediation provides a platform for more diversity of skills to play out in tackling conflict. A third party with a fresh perspective, with no conflict of interest, adopting a professional approach, takes the quality of the intervention to another level which would yield more credible outcome. This technique also helps to provide a calm environment when dealing with conflicts in relationships. A professional mediator would help partiea focus on the solution rather than recounting each other's wrongs. This would result in a peaceful discourse and enable parties to be open a suite of possible solutions.

As part of the preparation for mediation it is important to establish the nature of the conflict and establish whether you possess the requisite skills to do the mediation yourself. It is necessary to gather as much data as possible from the conflicting parties with deliberate assurance of strict adherence to confidentiality. There is need to assess the suitability of venue to be used for engaging with the parties. There is also a need to arrange for a suitable time in the day for all parties. A meeting outline should written down to ensure a structured approach and optimal use of time. It is important to work out the planned duration of each session. There may be a need to plan for action items for follow up at the next meeting.

Meditation is all about paying attention to everyday events with purposeful curiosity and openness. It entails immersing ourselves in the present moment and being aware of what we're doing while doing it with a non-judgmental attitude. It sounds simple, yet it's becoming increasingly difficult to find time to pause and reflect. Mindfulness challenges us to be present in the 'here and now' rather than fantasizing about how life should be. It urges us to observe the essence of the present as it is, so that we do not miss out on what is happening right now. The advantages are substantial. Regular mindfulness meditation enhances concentration, decision-making, and working memory, according to research. It relieves tension and stress.

The management committee convened an immediate meeting and formulated a plan for mediation. A three member committee consisting of Company Physician, the HR Manager & myself as Staff Facilities Head was established to address the situation. To handle the expert's absence discreetly, we portrayed it as an illness. Armed with bouquet of flowers, we visited his room where the Physician conducted his medical check up. Subsequently, we accompanied him to the clinic where he was prescribed some medicines. He was advised to take one more day rest on medical grounds. Throughout the process, we ensured utmost respect for his dignity, and his frustration gradually transformed into a sense of understanding. He became motivated & retuned to work.

A thorough and effective mediation session gives a fair chance to both parties to be generous enough about the other. First and foremost thing in follow up is to recognise & appreciate the efforts of the other party towards resolution of the conflict. It's your appreciation which shall pave the way for engaging continual discussions and keeping you uptick on the task of reaching your end goals. Secondly, a mistake repeated again and again isn't a mistake anymore. Be cautious of the things that have let you down earlier and be resourceful enough for the execution post mediation. Where security risk is identifiied during preparation, the approach would be tailor made to suit situation. For example, agreeing with the parties to have more than one person attend mediation sessions and meeting in a neutral place. However, it should be noted that some of the behavioural patterns of the parties may not be identified at the time of preparattion and could manifest while mediation is in progress and this calls for agility on the part of the mediator.
