It is imperative to select and develop people in this domain which will be the cornerstone for IP activities in R& D. First and foremost identifying people who can work in this area and develop. In R& D there will be two type of folks inventors/ Innovators and people who help them to invent/ Support. Invariably inventors has to be the owners and should be part of IP/ patenting excercise. The Support people is where R& D managers has to use discretion

Generally one begins the research work on a broad suject given by the research guide. The next activity is very crucial. This next step is literature search to identify the window for research where there are no prior arts. It generally takes sometime more than six months to do a thorough literature search and study the claims and prior arts which have already been made by earlier researchers. If this part of the research work is done thoroughly and all related prior arts are carefully studied the chances of conflict of intellectual rights become minimum. The next step is to track the research work happening in other parts of the world on related subject and publish papers periodically to become owner of the subject of his research.

A simple rule is an idea cannot be patented but the realization of an idea can. Defending ownership relies on who owns the specs that can be processed into a value-added product or process.
