You're negotiating with a difficult client. How can you come out on top?

Negotiating with Difficult Clients (such as Single Source or Monopoly suppliers) is challenging but you need to do following 1) Never focus on short term view. Almost everytime, you can get leverage based on bigger picture view. i.e get strategic 2) Chip away their dominance over time. Start small and introduce new suppliers or replacement products. Keep your monopoly supplier updated on these developments 3) Lastly, establish a higher entry price for new market or new category for your monopoly suppliers. The only leverage for you is volume, new product or new category. Use it wisely.

Whatever type of client, first thing is to understand your BATNA. What’s your best outcome and least acceptance outcome. Least acceptance outcome enables you to know when to walk away from a deal. Remember, it’s better to have no deal vs a bad deal Secondly, make it collaborative and try to understand what client’s real interests are and how can you increase the pie of negotiation

BATNA is key. Know your non-negotiables. I find starting a negotiation with the smaller and easier items and doing so with a partnership attitude does wonders for everyone to feel satisfied with the outcomes on the larger issues later on.

In my experience, successful negotiations require resilience and adaptability. Knowing your BATNA, the best alternative to a negotiated agreement, is crucial. It provides a baseline for your negotiation strategy. However, during the negotiation process, circumstances can evolve. It's essential to identify the core reasons for the negotiation and stay open to adapting your approach. By keeping the conversation going, even when faced with challenges, you maximize the chances of finding a mutually beneficial solution. Don't be discouraged by setbacks; instead, use them as opportunities to refine your strategy and reach a satisfactory agreement for both parties.

Don't focus on coming out on top! Set your ego to one side, and work on finding out why they are being difficult - there is usually a reason. 3 things I would recommend: 1. Ask questions, listen, be creative. Work out how you can help them. 2. Don't make it all about price. What else do they care about? Payment terms? New products? Delivery schedules? 3. Understand the power dynamic. We often think the other side in a negotiation is more powerful than they actually are. What are your sources of power? What are theirs?

The best thing to do in a negotiation is to ask questions, probe for information, and identify interests behind your opponent's position. This requires active listening. In any negotiation, your clients or opponents likely have both a position and an interest behind it. If you cannot satisfy the position they are stating, you may be able to overcome that entirely by satisfying the actual interest behind the position. Listening to what your client says can help you find a way to satisfy their interest while also potentially satisfying you own.

“Listen more than you speak” is the best advice when it comes to negotiations. You learn the goals and motivations of the other side before disclosing your own. Working to help them get what they want is an excellent strategy to encourage them to help you in doing the same. If you find the conversation is excessively one-sided, and they are taking more than they are giving, you always know your BATNA and non-negotiables, where walking away continues to be a viable option. If that’s the case, the other side loses so it’s in their best interest to support your goals too.

Customers don't always know what they want. Hence, they could be placing too much emphasis on price, or some other criterion that aren't your strengths. You may want to reframe the customer's thinking, so that they align their interests with yours? You can say something like "I understand that you are facing a lot of cost constraints have have limited budgets. At the same time, you would also want to ensure consistent quality and reliable up-time for your production. What if by going for a lower-price solution you may encounter unreliable quality and up-time? How will that effect your operations?"

Picture yourself sitting on the same side of the table with the other party and solve sticking points as a team. You and your counterpart may share common interests, invisible to those who cannot see beyond their positions. "I do not want to sell and asset, no matter how much you pay for it". This seems impossible to reconcile. But it may be the case that I don't want to sell because I am afraid that I will not be able to have access to that asset post-sale. Maybe you do not have a problem with that. But we can only find out by digging deep into our various interests, to see where they may be able to co-exist. The area where interests may co-exist is commonly called ZOPA (Zone of Possible Agreement). The obvious ZOPA is the price range where both parties are willing to close a deal. But in most real-life deals it is important to understand interests.

A negotiation without guideposts is just parties stating what they want without any basis for it. Ground a position in a precedent and you’re already ahead of the game.

Any successful negotiation requires you to separate the person from the topic at hand. If you cannot do that, it is likely you will end up offended or offending the counterpart - which may sound silly but happens frequently. An intelligent way to do this is to always refer to the issues in a "third person" way, making it clear that eventual criticisms you may have are not directed at the person you are negotiating with, but rather at the setup you intend to change. Quickest way to derail a discussion is to direct criticism at you counterpart. You lose face, and may lose the entire negotiation. Be cool - think it through. Choose words carefully.

Emotions can certainly play a significant role, especially in challenging discussions. I've found that preparing mentally and taking strategic breaks not only helps maintain composure but also contributes to clearer thinking. Expressing feelings constructively and reframing situations positively have been key aspects of my approach as well. Understanding and addressing the emotions of the client is crucial for building rapport and finding common ground.

Many a times negotiating with difficult client like market leaders, we may end up in deadlock situation.. To avoid this we need to do lot many homeworks , data mining about the market & about the opponent , about their needs.. Perform SWOT analysis & find out their weakness or flaws and that should be the starting point of negotiation.. Also to add more weightage to our side we need to explain about our positives, our strengths & convince them both psychologically & with realtime data , how this deal may end up, meeting their current & future needs..Hence by this way , for sure , we can win any negotiations with any difficult clients..

Managing a difficult client is never easy. And so we must be assertive to pick our battles with this difficult client. It’s important to look at the bigger picture with a view to sustain a longer term strategic relationship. With that in mind, we must always stay professional, be patient, and listen more to the client but with great EQ (emotional intelligence). In the eyes of this difficult client, we will always be viewed as the trusted partner.

“Assertive” is an interesting thing to consider. Why are you trying to "come out on top" ????♂? If they're your client, it's not a battle, you don't win or lose. Wrong frame.

Stop negotiating. Add perspective and support the cause of the counter party. That’s the winning attitude and will enable a win win situation. It’s never a tug of war. Which we always make it to be. Not one really cares to win on all points in real life. Everyone has a few agendas where they want to score. Figure this out ; create a win win by give and take policy. Start by looking at the counter party point of view. Then offer what she / he (really really) wants in return for what u really want. Example Offer a price reduction by selling a higher quantity Offer a price reduction by giving a higher quality at same price. Offer a price reduction by co-investment so that long term supply is ensured. Value add.

Know simply what "coming out on top means". Know well the priority of your needs and the value to the counterparty of what you offer. Actually, don't think about winning as much as getting what you need plus unanticipated value from the counterparty while offering in return that which has high value to the other side that costs you little as possible. Furthermore, take into account if this is a onetime deal or one of many with the counterparty. If you insist on winning, win the war not just this battle.

Whenever possible, use data specific to the client when presenting your positions/arguments. It's often difficult to rebut or reject one's own data.
