Your contractor is not meeting environmental standards. How do you ensure they meet the requirements?

To ensure contractors comply with environmental standards: 1. Clearly communicate guidelines and regulations. 2. Provide training on environmental compliance. 3. Define roles and hold contractors accountable. 4. Monitor progress and address issues promptly. 5. Offer resources for eco-friendly practices. 6. Incentivize compliance with rewards. 7. Enforce penalties for violations. This approach fosters adherence to environmental standards and promotes sustainability in construction projects.

One thing I can add based on my experience in our projects is to consider environmental and safety management system as a criteria in contractors proposal review and evaluation during a tender document evaluation. This system basically breaks down to documents such as environmental and safety policy, manual,risk assessment procedure, responsibilities and athorities and supporting documentation. During the project time contractors must adher to their established EMS or obey the employer's EMS depending on the agreement in contract. An environmental inspector assigned by main employer will do the daily inspections from construction field based upon the project EMP.

It’s important to define scope of works and outline specific tasks in a contract. For example, we need to specify who is responsible for managing the waste, what is the requirements and standards need to be complied. All environmental-related concerns should be communicated clearly during the kick off meetings prior to commencement of work

The project Management Strategies and Implementation Plans(MSIPs) such as C-ESMP, HSMP, GRM, Emergency/contingency plans, Code of conduct, Waste management plans etc. The Contractor shall prepare the MPISs and approved by supervising consultant for implementation. However, MSIPs are communicated to employees at all levels via inductions, toolbox talks, trainings. Supervising consultant shall closely monitor project implementation activities with respect to ESHS management/performance and ensure Contractor complies to MPISs, regulations and maintain best practices.

Make sure that the agreed contract includes a clause for environment, health and safety considerations. Define the responsibilities of each parties. Include a discipline clause containing any penalties for any negligence of EHS responsibilities. The accountability of contractors for environmental issues must be notified during the tendering process. Inform contractors that the environmental protection and possessions of a comprehensive environmental health and safety management system is mandatory for the project.

This is very important to enforce contractors because in many cases we have faced contractors that disobey the existing and already communicated instructions because those mitigation measures increase their workloads and costs as well. Therefore it is necessary to consider a discipline clause in contract regarding any professional misconduct and disobedience from all parties which disrespect environmental rules. It could be reducing a percentage of payments as well as a negative record of the contractor which will affect their qualifications in future projects. In the other hand we can consider awards for contractors who appreciate limlitations and even goes above and beyond expectations.

Basically this is an issue that should be clearly communicated during the initial phase of any project so whether its written in the project charter or in the project planning documentation the contractor must have a clear idea before hand about the environmental standards that he should follow ,so the issue is weather the documents weren't clear or the contractor isn't following the standards in which case the conflict should be resolved also according to the project management resolving techniques.

Encorage contractors to be certified with environmental management system and consider the certification in tendering evaluation process. To become certified contractors employees will have the opportunity to go through various environmental training and awareness. Additionally they must be provided with company project EMS documents such as project environmental management plan from which they can learn about project risks and mitigation measures. We can organize regular environmental orientation for contractors in order to give any required awareness.

Contractor participation in ongoing risk assessment and updating risk register is an effective way to communicate the project EMP and relevant mitigation methods. Moreover they can bring their thoughts to the meeting and help to identify more aspects and relevant mitigation methods.

Based on my experience with large EPC projects the contract must contain a clause regarding environmental protection requirements and responsibilities of all parties engaged in project. The contractor must provide their evidence of an established environmental management system during tendering process. Contractor must follow the project environmental management plan during construction daily activities. An environmental inspector assigned by employer must inspect the field in a daily basis using a checklist derived from environmental management plan and provide the inspection report, communicate observations and non conformities verbally at field and issue non conformity and corrective action accordingly and follow up to resolve issues .
