What's the best way to approach a tenant about lease renewal?

In my experience leading our leasing team I have always focused on objective’s. "Absolutely, understanding the tenant's objectives is key when approaching a lease renewal. By actively listening to their wants and needs, you can tailor the renewal process to align with their goals. Also, being informed about market comparisons and objectives enables you to negotiate effectively and ensure a mutually beneficial outcome. Striving to meet the tenant's needs while considering market dynamics can lead to a successful lease renewal.

Understand the lease terms and conditions pertaining to the renewal of lease. Take into consideration the Lessor requirements. Understand the requirements of the Lessee and their business. Get in as early as possible. If you have worked with the Lessee over time you should have prior knowledge and would have had discussions about the renewal of the lease prior to being in the window of opportunity. Present market rent (subject to rent review clause of the lease) and negotiate fairly. Always put conversations in writing. Follow up regularly until the matter is finalised and documented accordingly. Keep the Lessor informed throughout the process.

Review Existing Lease Agreement: Begin by reviewing your current lease agreement to understand the terms and conditions, including any renewal provisions. 2.Renewal Intention Communication: Communicate your intention to renew the lease a few months before it ends, ensuring this period is at least equal to the duration for which the security deposit was made. 3. Negotiate Fairly: Negotiate the renewal terms in good faith, offering a fair way forward. If the property lacks amenities required by industry standards or the tenant's needs, offer to include them from the renewal period onward. If you still encounter difficulties in the renewal process, consider engaging a lawyer to assist you.

It's also very important to understand your client's business and their needs as that can often help you offer incentives or help them see things in a different perspective. Since oftentimes if all a tenant hears is that their rent is increasing, they may automatically be inclined to leave, without realizing the impact it could have on their business.

Honesty is the best policy in Diplomacy. Best way to approach the tenant about lease renewal would be asking them courteously through email or web based apps (if available) before their notice period. Landlord can inform the tenant about the escalation clause or any incremental rent that might be applicable due to current market demand and progressive pricing at other commercial facilities to generate inquiry from the tenant for renewal. It has to be clearly clarified to the tenant if they intend to either expand in the current facility or shift their work operations then the option of renegotiation can be explored for the current leasing terms to encourage the tenant for renewal and continue the fruitful business relationship experience.

When discussing a lease renewal with a Tenant, it's important to always be in communication with them, while putting a relationship-focused emphasis on the conversation. Thank them for their tenancy, find out if they are satisfied, and talk about possible upgrades. Some Tenants remain in occupation for years, but the Property Manager overlooks this during the renewal process.

Be proactive with your tenants throughout the tenancy and not only when it's close to renewal time. This built trust, rapport and a sense of partnership that all tenants appreciate.

As a landlord, I have found it beneficial to connect with my tenants throughout the term of their leases and not just reach out to them when I want them to renew. An example I've seen that could go south is literally sending a lease renewal three months after a tenant just moved in. October is way to soon for someone to decide.

If you have a good relationship with your tenants, and they like and trust you, this is a huge benefit for them to stay. This starts with the showing to the application process, to the lease, to the tenancy. We do offer flexible lease terms if necessary to retain a good tenant. That may be an extension of a couple of months or a 6 month lease for a tenant who is not sure what their next steps may be.

Additionally, fostering a positive landlord-tenant relationship can greatly influence their decision. Regular communication, addressing concerns promptly, and being attentive to their needs can cultivate trust and loyalty, making them more inclined to renew their lease. Building a sense of community within the property through events or amenities can also enhance their overall experience, further solidifying their desire to stay.

100%! Don't go into these conversations thinking its your way or the highway. Oftentimes, many tenants just want to be heard. So if you're able to listen to them and respond to what their needs are, you can often salvage what would be a tenant move out.

Especially when we are dealing with a long-term tenant, they sometimes want the place freshened up a bit during their tenancy. A little will go a long way to retaining such a tenant. We try to understand the situation the tenant finds themselves in before lease renewal. Did they fall on financial hardship? Did their family change (new baby, kid went off to college, a loved one passed?). Knowing your tenant can help you make different decisions related to rent increases etc. From what we hear from applicants, many property managers and landlords do not take the time to understand tenants situations. Not that we can always respond or react to their situation, but we can always acknowledge their situation.

Similar to why it is important to walk the space and continue your relationship with the tenant to see what their physical business needs are, it's important to listen to them at the time of renewal especially and consider their financial health in relationship to the term proposed. If they are a long term tenant that is having a rough time due to the economy, maybe you execute a shorter term renewal at a slightly higher rate. Ask open ended questions during your meetings/calls with them and see what their 1, 5 & 10 year plans are.

I appreciate that are mentioned above. These are almost all the DOs and it does not contain DONTs. If a landlord just give all these options from his side then probably the landlord seems to give free-hand to the tenant. As we know from the perspective of litigation that the tenants may take unnecessary benefits when landlords give so much relaxation to their tenants while dealing to extend the tenancy tenure. Ultimately the landlords put themselves in difficulties. So landlords should give that much which the tenants have their due rights. Excess of everything is dangerous. Secondly, the tenancy agreements must be made and executed in such a way that it will benefit both the parties and may not jeopardise the rights of the other.

When working through a lease renewal it’s a great time to fix anything that you may have missed when you negotiated the original lease. Maybe we learned something new, or the laws changed, or your attorney has started adding specific language to new leases. This is the time to get that language incorporated into your renewal and end up with a better agreement!

We use the standard Realtor documents plus our own addendums which reflect our learnings over the years. We take the time to review these addendums with our tenants, especially if we made changes. Tenants need to have a clear understanding what they are signing, and they need to understand why we added one or the other item to their lease renewal.

To save time, provide clarity and make the documentation process smooth and effective, send an e-mail after the terms are agreed upon (and a Letter of Intent for their signature when appropriate). This will make it much easier when sending the lease administration or legal for drafting, and will eliminate any confusion down the line over conversations you may have had before the final terms were agreed upon.

I’ve found the best way to broach the renewal is to put the onus on the tenants, put an automatic renewal in the lease requiring your tenants to notify you 60-days prior to the lease expiration date.

Always do your due diligence, if the complex is mainly that of families with children's don't bring in whoever just to the occupancy rate, it may tarnish your reputation as family and children friendly.
