What are some of the best practices for organizing and documenting your R&D patent search results?

In my experience, I have used keywords of the subject as well as directly going to public websites which patents are stored. Also, there are few ways to narrow down your search to specifically find out whom are the competitors and whom have other related patents in the field, one way is once you find a latest patent in the field you can go and check all the related patents that they referred or reference it too in reference section, in most cases you will find a big list of patent names, company or people names and the year that is being published. This is one of the best ways to I used to research around the product and the patents around it. Another way is to look for latest review published papers and again go to the reference section.

It is important to start by brainstorming what search terms you will use. Including synonyms and related terms in initial searches will help prevent missed art that may describe the same concept with different terminology.

I agree but also believe it doesn't always have to be categorised, all depends on what you are looking for. One tip for me is to organise my search by main topic and the key aspects of that product or process around it. For example most of patents want to claim a huge area or type of materials or processes, and generalise their claims. So you need to read carefully what is so specific about the patent you have found then start organising them.

You can also use this point in the process to highlight any art or companies that you want to continue to monitor, and set up checkpoints for when you perform additional searches. Those checkpoints can be based on project timelines or specific stage gates to correspond with how the project is being managed.

One thing I found helpful is to first find out what product is out there in the field you are after is available, then find out whom is the patent owners and what is the history of technologies that they built around it, then have a terminology to categories or divide all competitors and their products with the excising patents summary, so you have a good understanding of the technology and how you can improve or impact it from technological point of view as well as market evaluation point of view.

Depending on your audiences, in addition to the detailed report, a summary report can also be useful. Some audiences want to stay in the loop, but may not have time to read the detailed report, or want to scan through it to get to your conclusion. Creating an even more concise summary from the conclusion section of the detail report may be all the information certain audiences want to see. If they end up wanting more detail, they have access to the full report. It's important to tailor reports to the audience for best effect.

Over 99% of chemical consultants do not know there is different way to search the early literature that can reveal how to break the competitor's patent filing. Most do not know how to search the paper Chemical Abstracts which is organized in a different manner than the electronic version which cannot shift easily between disciplines.

It is quite important to keep being updated, and again I still keep the academic publications as one of the main sources to keep looking as if it's a new technique or process majority are going to be a potential patent or already a filled patent in their own country, so you have to keep looking wide to be updated, however in most cases having a patent lawyer or legal advisors could speed up your results.

You can't start too early in searching for prior art related to your research. Depending on what's out there, it can be overwhelming to do it all at once. By starting early and keeping abreast of any competitive filings, you can feel more secure in knowing how your art fits into the broader "patentscape" and how to write your application accordingly.

One thing to consider is you really want to be sure that if you are going to patent the idea/product or keep it as a trade secret, and how strategically you can stay alive in the market if you don't want to patent your technology.
