Negotiating with an emotionally invested party can be challenging and stressful, especially if you have conflicting interests or values. However, with some preparation, empathy, and communication skills, you can achieve better outcomes and preserve the relationship. Here are some effective ways to negotiate with an emotionally invested party.
Before you enter the negotiation, try to understand what emotions are driving the other party and how they affect their behavior. Are they angry, frustrated, fearful, or passionate? How do they express their emotions verbally and non-verbally? What are their underlying needs and concerns? By empathizing with their emotions, you can show respect, build rapport, and avoid triggering negative reactions.
Active listening! Hear not only the words being said but the emotion behind them. Put yourself In their position. Think of how you would feel. Then take a deep breath and remind yourself they are not attacking you or your presentation. Help them see and feel what you are trying to share and empathize with what they are sharing back. A mutual understanding of both sides will ultimately end a win-win for all involved.

Clearly, finding “common ground” or leaning into the construct of “associationism” in negotiations is what drives a balanced outcome. Understanding the emotion behind a position allows for empathy to lead the conversation. This becomes paramount when the types of negotiations regard loved ones, heirlooms, and items deemed sacred to one ( or more ) party. Leveraging vulnerability as a strength in emotive contract based endeavors has in my experience, proved more powerful a tool to reach said common ground than not.
You also need to manage your own emotions during the negotiation, as they can influence your judgment, communication, and decision-making. To do this, you can use some techniques such as breathing, reframing, or self-talk to calm yourself down and stay focused. You can also acknowledge your emotions and share them with the other party in a constructive way, such as saying "I feel frustrated when you interrupt me" or "I appreciate your enthusiasm for this project".
A few of the physical check-ins that I do to manage my emotions in emotionally-charged negotiations are focusing on slowing down my breathing, check-in with my body to see if I am clinching, drink a sip of water, or closing my eyes. I also tend to make notes to transcribe what they are saying into a visual for myself to focus on the information instead of the situation. I PAUSE before responding or speaking. I Consider the feedback they are giving, was it helpful? I try to change my thought process to be more curious than stuck in emotion. If the emotions continue to rise, I mirror what they are saying or ask them to provide their insights.
One of the key principles of effective negotiation is to focus on the interests of both parties, rather than their positions or demands. Interests are the reasons why people want something, while positions are what they say they want. By identifying and addressing the interests behind the positions, you can find common ground, generate creative options, and avoid deadlock. For example, instead of arguing over the price of a contract, you can explore the value, quality, and timing of the deliverables.
This element directly ties into my thinking on emotive negotiation … it is fundamentally advantageous to dislodge the key elements of the contract and explore the value adds and how they benefit either/both parties factually and objectively to remove the pain points that are behind the emotional peaks.
I try to be personable and get to know them just a bit. I then try to match how they communicate, how they want to be answered, etc. I strive to help them feel more comfortable. That is my subtle way of trying to work through the situation together versus feeling like adversaries.

Active listening is like working out: different focus areas require different approaches. Sometimes I take notes to show I am listening, sometimes I hold eye contact, sometimes I just ask the person what they want from the interaction: support/ listening or action. I think a lot of active listening is just trying (without assumption of what is needed) holding the space and time to be present with the person trying to communicate with you.

When emotions start to get high, I usually try to bring the conversation back to the reasons and factors that brought us to this point in our negotiations. Try to brainstorm with the individual/s about what we can learn from the past experiences, how can it inform our approach now? Like we are trying to solve a puzzle together...
Finally, you should be flexible and respectful throughout the negotiation process, as this can help you to adapt to changing circumstances, overcome impasses, and maintain goodwill. Being flexible means that you are willing to make concessions, compromise, or change your strategy if needed. Being respectful means that you treat the other party with dignity, courtesy, and honesty. You can also use positive language, humor, or compliments to ease the tension and show appreciation.
I like to validate feelings when I hear a valid complaint and frustration from someone. I try to find a positive factor about the situation or individual to bring the conversation back to. Why are we having the conversation? When I am trying to be present for my team and provide support, if my ideas do not seem feasible, I ask for ideas and solutions from them.
