The first thing a Property Manager should do is to review all the maintenance records, inspection reports, and records of communication with the tenant. But, as a real estate legal advisor I would highly recommend to review the lease agreement and the legal obligations incumbent upon both the landlord and tenant under the applicable law. In practice in Spain, I rely primarily on the Spanish Civil Code and the (Spanish) Urban Lease Act. Ensure you consult relevant laws specific to your jurisdiction. Conducting this review will allow us to identify specific clauses that may be relevant to the situation in question and determine whether there has been a breach of our duties as property managers/legal advisors.
