Desafortunadamente cuando las cosas ya están en disputa no es fácil mantener la calma y un tono amigable. Justo hace unos días, en un proceso de “mediación” en cierta notaría de la ciudad de Monterrey, escuché el comentario de una de las partes: esa tasa que estás aplicando es muy alta y la estás considerando sobre todo el monto y no sobre el saldo no pagado. Es necesario, para evitar este tipo de problemas, que desde el inicio de la relación comercial se acuerden por escrito las obligaciones de cada parte, y que se revisen los documentos por los asesores (no solo por el administrador interno), esto si bien no resuelve que no existan problemas futuros, si los aminora al conocer claramente lo que se pactó desde un inicio.

Siempre es conveniente arreglar cualquier disputa en forma interna y de buena fe, usualmente si falla un arreglo entre las áreas comerciales u operativas, puede escalarse a nivel directivo. Sin embargo los conflictos no siempre se pueden resolver, por lo que se puede acordar, ya sea en el propio contrato o en un acuerdo posterior, que se realice un proceso de mediación ante las autoridades judiciales para intentar llegar a un acuerdo, y evitar llegar a instancias procesales que seguramente serán más tardadas y costosas. Respecto al arbitraje, aún y cuando es una buena medida alterna para resolución de conflictos, se sugiere analizar los potenciales montos en disputa y el costo que pueda tener el proceso de arbitraje.

5 Know when to end the relationship

Sometimes, despite your best efforts, you may not be able to resolve your conflict with your property manager, or you may find that the relationship is too damaged or toxic to continue. In such cases, you may need to end the relationship and look for another property manager or another property.
