This is a common problem in my country specially in public construction, because there are projects in previous phases that are aproved in that form and could be conflicted with the real conditions in the execution of them. It's important that the three parts involved, Contractors, Regulators and in this case the public entity who solicites the project have the same knowledge and information of the problem in topics like budget, objectives and projection, in few words, collaborative work by the parts.

This not a second step, it is the first and most important step. Regulators are not evil beings looking for the slightest misstep. They are fully experienced individuals whom are responsible to legislators to ensure the wishes of government through complex legislation and regulation are followed. There is very little room for negotiation, as they interpret and render decisions based on interpretation. They are also human. They key to success is to build trust with them and always be honest and respect their position. Dialogue early, especially when you know in your experience, your client or stakeholders or the public are not going to be in agreement with your project. Be realistic in schedule and cost expectations. Communicate often.

Secondly engage the regulators in the preliminary designs to ensure no or little discrepancies from the prescribed regulations Always ensure to pay promptly for their approval, supervision and any related fees toward the design You may wish to attend and be part of their training, conferences and related learning basis from the regulators

I am going to fully agree with Genes response here - as a current regulator and previous designer/project manager he hits the nail on the head. Regulators are more than willing to work with you to get things done right the first time, they take no pleasure in multiple design review cycles. And they are often more than fully capable of design/management - dont treat regulators with the mindset of "those who can, do; those who can't work in government" Regarding the response of data driven AI - I fail to understand what is being promoted and how it realistically can be implemented. Seems like techo babble.

I agree with this... mostly. At some point regulatory standards are regulatory standards (and some may present conflicts with other regulations). There is often room for compromise, especially if there is a sound engineering argument backed with data/analysis. I often see assertions from designers that aren't backed with evidence - and that puts the regulator in a tough spot and unable to adjust interpretation of regs without "owning" negative consequences. It is also important to recognize that sometimes the compromise and negotiation needs to be with client and engineer. To meet environmental and storm water requirements, the new development may need to lose a few housing units. Hurts the financials, but resolves the regulatory log jam.

Early and effective communication between all parties involved is one of the keys to a project's success, and enables common ground to be found for negotiations and compromises. Regulators and other stakeholders need to work together regularly to implement projects in different environments, and to resolve any problems that may arise together.

Negotiation paves the way to a solution. In a project, conflicts are bound to happen. Stakeholders should get used to it. Our views on various aspects of a project are divided due to different perception. It is a human nature. Finding a common ground is the goal. It takes time and effort to meet or exceed the regulations. Negotiation helps reach a solution.

Compromise here is bit a negative word. Optimisation of the opinions and arriving to a common minimum program may be explored.

We all have a standard of care, and often the escalation becomes a political ask for the regulator to "bend the rules" or speed thing up to the detriment of other precedents/projects. The risk of acquiescing falls squarely on the regulators shoulders - they bear the cost but reap no benefits. They become perceived as the problem, when in fact the real problem may be poor project planning or an unwillingness to tell the client " this can't be done". And over time this bending of rules becomes expected. As a regulator I then ask, are we upholding our standard of care? My duty is to protect the citizens, not get your project built faster or by cutting corners. Escalation is a good way to make an ally an enemy. Be cautious.

In my experience, project inception and implementation phases suffer the blunt end when constitutionally mandated regulators and politics of the time conflict and interests fail to align. Escalation to higher levels may negatively influence project design and implementation when higher powers invalidate regulator's concerns. A civil engineer should understand the project dynamics and move with caution to ensure that the integrity of the project is not compromised.

I think the timing is very important aspect while escalating the issue. Raising the issue too early or late to higher ups may multiply the severity of the case.

If we want to reduce C02 emissions on our major infrastructure projects we need to implement this into our regulatory requirements. For example, using alternative green concrete mixes on non-structural elements such as concrete barriers, noise walls, parapets etc. If updating the code takes too long, we need to work out how we can get approvals outside of regulatory requirements.

To reinforce what is highlighted above "Learn and improve", detailed design and information needs to be shared between stakeholders for good collaboration, feedback or recording, and be open for comments.

Building codes and standards sometimes act as roadblocks for productivity. It is important for clients, project sponsors, governments and contractors to gain alignment on our projects to develop feasible and practical solutions. You need to make the standards work for your project and not the other way around.

Working with the regulatory bodies or getting the project completed with proper compliance clearances is an paramount fact which needs to be given the highest value during the initiation or running phases of the project,it needs to be understood that those bodies are there to check and ensure that every tiny bit is done as per the standardised documents,and it's for the safety,structural integrity of any construction project, sometimes yes there are points where we can feel no we are right,there compliances aren't,the considerations should be given to provide as much as the practical data towards the bodies to let them understand briefly that what can make it even more better,afterall persons dealing with all this construction are among us
