In both scenarios it's extremely important to give full disclosure on how the data collected will be used by the organization and seek consent from candidates.

This includes understanding data collection, storage, and disposal requirements. Develop and communicate clear policies outlining what data you collect, how you use it, and how long you store it. Obtain candidate consent for data collection and usage. Ensure all personnel involved in the hiring process understand the importance of data privacy and how to handle candidate data securely.

The tools and platform are the most critical aspect on data privacy. And there is a wide range available in the market. The decision on platform will depend on the size of the data and geo-spread of the company. Some of the global big tech companies have more that 15 million records in their ATS alone beside other tools. IMO: go for companies that been maintaining and improvising their platform for a long time (say 10+ years) and have a backing from another big company. For e.g. PeopleSoft is owned by Oracle, Kenexa by IBM, SuccessFactors by SAP, etc. That way you know that they are not going to close down so easily due to funding issues and data will remain safe (hopefully!).

Only collect data that is necessary and relevant to the job opening. Avoid collecting sensitive information unless required by law. Anonymize candidate data as soon as it is collected and throughout the screening process. This helps protect against identifying individuals.

Sometimes I hear about recruiters outside of data protection regulated areas such as Europe or certain USA states, sharing candidate CV’s without any permission or thought for the candidate, and putting their own gain first. TA professionals need to understand the potential consequences of sharing a cv without permission, which could cause the candidate being known as looking for something new (even when they may no longer be). The consequences can include fines, lawsuits and malpractice claims for the recruiter as well as job loss, reputation loss and long term career damage to the candidate. Data protection and consent should always be taken seriously and unethical recruiters need to stop rolling the dice in favour of speed.
