How can you benefit from using design-build contracts?

Design-Build is all about partnership. Risk can be managed ( and should be) by careful pre-award vetting of your Contractor. Reputation, financial strength, integrity, and their body of work all mitigate the risk of failures/bankruptcy/or non-performance. You still get market-based cost but filtered by a team perspective, not a "gotta be low" view. Once the team is assembled, the process is faster, more controlled, better evaluated, and more fiscally sound. "Skin in the game' makes everyone perform better. The D-B contractor is involved in potential VE discussions well before the thud of market evaluation. We have input into cost and design combinations , means and methods of execution, and the truest desire of the client for the project.

I disagree. These contracts are usually controlled by the BUILDER who puts profits and speed above other elements. While more innovative designs MAY result, often the Designer is constrained by the Contractor and the inspectors, if any, are also paid by the Contractor (a real conflict of interest) and have limited say. You get a finished product faster, but I do not believe you get the dame quality as with design, bit build and Independent Inspection paid by the OWNER.

True, the design build delivery system does transfer more direction and control to the builder, and this seems to frustrate the more traditional designers, who are used to having all of the control. However with the right builder, the job gets done faster and is more fluid for owner design changes on the fly. The design bid build system has its place. Not everyone is successful transferring to design build as it requires a different approach to the process. Design build is a tremendous tool for the right team and the right project.

DB is great.... IPD is better. These goals can be achieved with normal Design, Bid Build contracts by encouraging more contact between designers an contractors in professional settings and through value engineering proposals that are cooperatively reviewed.

Design-build was useful back in the 80s for all the reasons mentioned. It changed with Trump's presidency, we got into an era of deregulation. Suddenly there were no longer any checks or balances which is necessary for quality control and good performance. We now have companies joining architects and contractors who are not subject to independent, third-party supervision. Permits Departments are run by administrators, not architects/urban planners ready to accommodate those new conglomerate offices. They are policing themselves. Worse, prepurchase inspections at the time of a building's sale have become deregulated. Quebec is an example. The 1994 civil code states a pre-purchase inspection can be done by the buyer; no need for expertise.

We prefer the D-B method. Our intent is not merely to give more control to the Contractor. Instead this is a direct result of performing past projects as D-B-B resulting in drawings that were incomplete, delayed or out of budget. We were the ones guilty of delivering such a performance with our Architectural Firm. It was a challenge to get decisions by our clients onto the plans. We did not know if clients were showing the drawings to contractors. In the end we had a project that was outside of budget. I can bring a unique and unbiased perspective to this debate. This is because I own both an Architectural Firm and a Construction Company. For those we can convince DB is the way to go, we now have the Contractor present from day one as D-B.

The communication and collaboration aspect just doesn't happen as well in DB as others. The contractor rules and design team are reduced to order takers. The client is involved up front, then at the end. This isn't always the case but certainly very frequent. DB does have it's place and I encourage you to seek out case studies where it was used and reported on realistically. Certain project types and owners lend well to DB - the value is finding those alignments.

I have found that relationships in these types of contracts are usually dominated by the Contractor with constraints put on the designers and enforced through delayed payment. Inspection personnel are generally ignored as irrelevant. This is not true innovation as the main focus is cutting time and cost for PROFIT, not for the benefit of the funding agency.

This comment is on the mark, but all the cautions I have stated still apply. You are dealing with a Contractor whose primary goal is shorter schedule and cheaper cost and those benefits will not accrue to the owner.

In the cases I have seen, the adversarial relationship of "normal" Design/Bid/Build contracts is maintained through Design/build contracts. Again, the Builder takes the upper hand pushing for decisions, not collaboration. The designer usually takes direction from the builder as that is who is paying them, and any Inspectors are left playing catch up or documenting what may be errors to just cover themselves. The Owner usually stands aloof so as to avoid any liability in case anything goes wrong.

If as an owner you wish to relinquish more control of the design/not be involved D-B works well. Otherwise a collaborative IPD or IPD Like system has all the benefits of D-B and more! As to risk. It is a fallacy to claim you transfer risk. In reality the owner merely hands of the risk funds (contingency in general) to someone else. Better to have partners that inform of risks and assist the owner in determining how much contingency is needed!

Project success requires careful selection of a delivery method that aligns with the project's needs. There is not a universally superior method. Many factors such as scope clarity, schedule demands, design control, project funding, market experience, and decision-making proficiency require thorough consideration. I am a fan of the Design-Build approach, but the effectiveness relies on project-specific characteristics. It excels when the project scope and purpose is clearly defined early. If design isn't finalized early and user input during construction require significant changes, the benefits of Design-Build diminish. The key is to tailor the delivery method after careful consideration to the project's goals and requirements.
