I have witnessed at close quarters how loopholes were found in client-vendor contracts and consequently allowed the vendor to "escape" penalties. I couldn't agree more on the criticality of due diligence and in case of an offshore vendor, the presence of a client representative "on the ground". This always enables the client to capture potential "grey" areas or loopholes and mitigate those areas, aided with discussions prior to any KRIs, KPIs and contracts being signed upon. Detailed market research, surveys and a review based on a scorecard are essential precursors before finalizing a vendor.
