A freedom-to-operate search can determine if there are existing patents that may be an obstacle to a commercial exploitation in a given jurisdiction. These searches and approaches are different: patentability requirements are assessed considering all publications irrespective of their origin, while freedom-to-operate is based on valid patents or applications in a given jurisdiction. A document may be relevant for assessing the patentability, but not for assessing the freedom-to-operate.
